Anyone knowlegable on moving radar speeding tickets

I am hoping someone can chime in. Recently had an issue with a police officer. Coming back from dinner with my girlfriend and her sister. A LEO coming in the opposite directions turned his lights on a attempted to make a u turn but got stuck with traffic going in my direction. I made a right at the next light since it was my turn. I then see lights behind me and I was the only one on that street so I pulled over into the first neighborhood which was a dead end. Turned the car off, lowered my windows and turned the interior light on but then he yells for me to stick my hands out the window and he has his firearm drawn. After a few minutes, another vehicle showed up and he comes up to my window and asked why I was fleeing? And why I turned into a dark dead end.... Told him I was not fleeing, that I turned down the street to head towards my house and that I turned immedielty after I saw he was coming after me. Asked me if I had any drinks and I told him yes, about 4 hours ago. After a 15 minute field sobriety test, he says I'm fine and hands me a ticket saying I was doing 62 in a 45. I drive this road regularly and I never slip over the speed limit. He says he got me with moving roadar heading opposite direction. When I tried asking him if there was any way it was the vehicle in front of me, he ignored me and walked off. Tried calling OnStar hoping they have a timestamp with a max speed during that period but no luck.I do not have a good record because of a lead foot years ago.I have not had a ticket in over 2 years and I admitted to all the other ones but I know for a fact I was not speeding. Anyone have any insight on moving radars? These are new to me and I only have his word against mine. Any help would be appreciated.

No insight...I did run into a moving radar though. Was late for work, 82 in a 55. Trooper turned his Tahoe around, through the median, and followed me right in the parking lot. I admited I was doing atleast 75, running late, etc. Asked me how long I worked there, took my license back to his truck. Came back a few minutes later..."not giving you a ticket. Just slow down! Next time I see you though..."

We have moving at work, but don't write it due to our court's policy thus far. Radar puts out a beam that goes out in a cone shape. It will bounce off the largest thing it has in its path, then return to the unit which gives the speed. Our units have a function where they'll give you the fastest speed if you have multiple vehicles coming at you. Technically we were trained to get a visual estimation of speed then confirm it with the radar unit. My advice would be to appear in court if you feel you were incorrectly ticketed. You can plead not guilty and take it to trial.

Call and ask for the officers qualification/training papers on the radar device he used on you to be available when you go into pay the ticket in person...chances are they won't have time to produce them and or he doesn't have them. Ticket should be thrown out of court if either is the case.

Don't know how things would work there, but in order to get the officers qualification/training papers here there's no such thing as requesting it for when you go to pay it. Either you admit guilt by paying it, or you plead not guilty on the appearance date on the ticket. A trial date would be set and you would be given disclosure prior to the trial date, this disclosure would then have the officers notes, certificates, etc. As the other person said if you believe you did not break the law then plead not guilty. It is possible his radar picked up another vehicle moving along with you depending on traffic. The officer has to do his job based on what his training, life experience, beliefs and perceptions are. He may have perceived his radar unit indicating someone was exceeding the speed limit, and believed it to be you. It likely didn't help your situation that he believed you to be attempting to evade. Turning off your vehicle may have made it look like you were then trying to hide, especially after having turned into a dead end.

Can also ask for proof as to when the Radar was last calibrated

Officers don't have to show you the reading.

Most modern radar units are self calibrating, you can use tuning forks to verify they are accurate.

As said the radar is "supposed" to be used to verify what the officer sees, a speeding car.

 

With that it is hard to beat speeding tickets in court. I was pulled over 3 years ago in my Corvette. Another motorist in a huge van passed me on the highway, motojock clocked the van and chased the van down. As I moved over to allow the jock to pass he instructed the van to pull over and then as I came by told me to pull over as well. Told me I was doing 78 in a 60. Told him there was no way, at max I was going 70 in the 60 and keeping up with traffic.

 

Friend was a Highway patrol trooper, he told me as was previously stated that the beam spread and return the hit back to the unit. he also went on to say small cars like Vettes were the hardest to clock if other vehicles were around. I explained the situation and he said more than likely the cop got the return from the van but was going for a 2 for 1 since I was in a Vette.

 

Went to court and the case was delayed, went back and ended finding out this cop had ticketed 6 other drivers for the same 78 in a 60. Hmmm, coincidental for sure. No matter what the court found me guilty, I asked to go to a higher court and was denied since the court didn't have a court reporter on duty. So basically I got stuffed for the ticket, not something I wanted with having a CDL.

Some with a few friends that are officers in Miami Dade. One of them is specifically trained for moving radar and basically said I'm SOL. I'm not going to take my chances and will just elect traffic school. Will be riding with my dash cam from now on though. The specific officer who pulled me over is trained and their guns auto calibrate so no go there. Not going to risk my insurance shooting up. My record 4 years ago does not look good so I know my odds. Sadly, I have no witness but another cop that definitely is not on my side

A long time ago, I was driving down a road and a half mile up ahead I see a cop car pulled over up against the curb going my direction with his lights on. So I check my speed and go past him. I couldn't have been going too fast, I had just pulled out onto the road. The cop pulls out behind me and still has his lights on so I ignored him. Then he turned on his siren.

I pulled over and he said I was speeding and asked if I wanted to come to the car to see the readout. I said no and he wrote me a ticket.

 

 

Now that I think about it, how do I know if that is my speed, or the speed of the person he just pulled over before me?

 

That guy must have been working on his quota!

This one time, or two different times, I got pulled over for speeding and got ticketed. But I was one of those rare people that was actually speeding at the time.

 

Op, the only thing you can do is tell it to the judge. You never know unless you try. And there's no way I'd pay an attorney 10 times the ticket amount to lose that case for me. That's just dumb.

None of these "tricks" actually work. Best you can do is contest it. Or stop before it goes that far- a gal I used to know who was a friend of a friend got warnings all the time for serious speeding offenses- but she also seemed to share shirts with her 6 y/o son if you get my drift. :lol:

Even if you were technically speeding, I got a ticket for 84 in a 65 when I was doing 70, you arent going to win. Plead no contest and go to traffic school. Chances are the fine will get reduced
