Car accident

I'm sad to say that my 2016 Chevy Silverado was rear ended a few hours ago... I'm very upset but I'm looking for some advice. I was hit by someone when I was going 10 mph in traffic and he was going roughly 45 mph and the truck bed is buckled and quite a bit of damage. The airbags said they went off but they didn't and I nailed my head on the steering wheel. I feel like something faulty happened and not sure how I should go about solving this. I may contact chevy. Also what do you guys think about the damage? I'm really hoping it's totaled because I don't want to try to sell a truck with a accident like this on its record.. So sorry to hear this. Makes me sick to my stomach. Able to see any frame damage underneath? I would want it totaled as well. A vehicle in an accident never gets repaired to what it was. IMO.

Absent a bent frame, there is some frame flex which would explain the bed contact. I think seatbelt pretensioners are in the seat buckle which would explain the service airbag.

 

Doesn't explain the head contact with the steering wheel. Were you buckled?

I was buckled in. Next thing I know I blacked out and the other truck was across the street with airbags and hood bent in half. The airbags definitely should've been out in my opinion. I am really sickened by all this. To top it all off the guy was illegal driving a company truck with a suspended Mexican license. Needless to say he was arrested

Airbags have multiple trigger events that must occur. If everything is functioning correctly and the bags didn't blow then you have to look at the locking mechanism for the seatbelt. Mine is real sensitive. If you contact nhtsa or the dealer they should be able to download the event recorder.

thank you I will look into it. I just feel like if that wasn't a hard enough force I don't know what would be. Pictures don't really do it justice but the damage looks worse in person

Sorry to hear this. I hope you're sure you're OK. A truck this new should be replaced. It really sucks to have to fight with insurance companies when you pay high premiums to protect yourself. If they repair it definitely demand loss of value and then trade it in.

thank you I'm okay. Just sore from everything and some pretty bad whiplash. I'm just worried I'm going to have to keep the truck. I want it totaled even if I lose a little. It has 4K miles on it and now it's got structural damage... I doubt they will want to write me a check. I meet with them on Monday. Hopefully I'm wrong

Their job is to limit the claim, they can't deny it. Your job is to play hard ball, not being unreasonable, but you should get a new truck, no BS. An impact like that sends a shock wave though the whole truck. Or you could take the check, buy the truck back for like $4000, take the $30,000 for the Insurance and make it a Trophy Truck.

You might want to get an attorney as well. They will look into your best interest. My wife was rear ended a month ago. She felt fine but then days later, started getting numbness down her back, arm and shoulder. Immediately went to get X-rays/CT Scan. All is OK (from a life threatening perspective) but chiropractic help was in order. They did some additional tests and found about 2 months of treatment.

 

Make sure you're ok. Especially if you blacked out. You don't want to settle (if that's what you end up doing) then find things out later. The insurance company from the at fault driver was very quick to settle. We denied settlement.

 

You are in a different scenario with your at fault driver though.... but keep those things in mind.
