It was probably hard enough. My friend was driving their 2016 Silverado and rear ended a dump truck. Airbags didn't go off. Chevy wound up taking it and looking at it. 23k+ in damage and a frame replacement... and she also hit her head on the wheel.

This your personal physician that concluded this? Our Physician didn't even want to see us because it was accident related and had to go an accident specialist doctor, which in turn, referred us to Chiro. All those items you listed needs to get followed up on. Each visit is loss time from work, pain and suffering, etc etc. Just in our visits alone, we're looking at $5K in billed services. X-rays, CT Scans, chiro rehab. Don't take for granted that things will heal on its own. I would like to see test results after rehab and compare them to what they were when you were first seen before saying "I'm good".

 

Wish you much luck in your recovery process both for you and the truck. I would get multiple opinions from several shops. Use GM parts, etc. make sure it's perfect if they repair it.

well when I said heal on its own they concluded there's nothing more to be done at for the day. I had all the scans and what not done. They said I need to follow up with a physician in 3 days. Until then they drugged me up and gave me prescriptions. I had to go to the er at the hospital because my regular doctor didn't have proper paperwork to be an accident doctor. The adjuster comes out on Monday so I'll know more then about the truck. Feels like a nightmare for sure!

Hope this turns out good for you! Hope you are ok as well. Take you time though. Many times additional injuries show up in a couple days. My DR always told me sometimes soft tissue injuries take 3 days to develop from the initial incident.

 

I think when push comes to shove the insurance of the company is in trouble as is the company owner. His rates are going to take a hit for allowing an unlicensed driver to drive a company vehicle. They are not negotiating from a position of strength. Document your expenses, document your lost time, make sure you are healed completely. Don't forget pain and suffering :) They will lowball, your attorney should highball and in the end you should get much more than you would have gotten. Not saying take advantage of the situation. I'm saying I would want a new truck and any expenses and lost time paid for at a minimum. I would expect a little something above and beyond that just for the pain in the ass. If they won't give you a new truck then at least get enough extra money out of them so you can go get your new truck. They can fix it you can trade it and hopefully get enough to pay the difference.

I would avoid talking to the company the other driver works for...hire a lawyer. Should be easy for them to get a nice settlement from that company. Let they lawyer speak for you. They knowingly let an unlicensed driver drive a company vehicle??? I would guess you'll get a brand new truck no problem.

Hope your injuries heal up quickly and don't give you years of pain. Be careful with the pain meds...those things ruin lives.

If you are going to get an attorney, do not call anyone other than to make proper notifications. It is much easier for the attorney to work, without having to maybe counter what you have said in the past (unknowingly wrong). Remember, emotions can make you say/do stuff that can make a situation worse. A good attorney (shyster) will work whatever magic can be done, and will guide you on what you need to do for your particular situation.

 

Everyone here will give a whole bunch of advice (it is the internet!), which may or may not be good. And the laws very state to state.

I appreciate everyone's information. I'm going to contact an attorney tomorrow when they open to sort everything out and let them do all of the work. Georgia does allow diminished value but at the very least if it's not totaled, I want a new truck and I don't want to lose any money. We'll see how everything plays out. Once the police report is out I will be able to confirm that it is in fact a company vehicle. (I could be wrong but I'm 90% sure it was due to the decals). Just one giant headache I wish never happened. But it is what it is and I do not want to get taken advantage of.

If possible, get a bunch of pictures of the vehicle that hit you showing the company logos...with license plates, etc...hope that company has money or good insurance. But I would avoid talking to anyone but your attorney. Anything you say can be used against you

Not trying to burst your bubble or anything but could be an independent contractor that puts client stickers on their truck. All the more reason to get an attorney. My guess is this should be a relative slam dunk for you to get a new truck if you pick a half decent lawyer.

I've already thought about what you said, but it was a 2015 Silverado that hit me. I doubt an illegal alien would be owning that but I could be wrong. Seems like a company truck. But I realize it may not be. I'm trying to find a good lawyer as we speak. Hopefully all works out

No I don't but my wife is a lawyer in Alabama and interviewed with them before starting her PhD. Basically King and Spalding is the biggest/best law firm in Georgia and possibly the entire south. They represent over half of the fortune 100 companies.

Hubby got hit in a guy driving a company truck. The guy denied that he rear-ended him. The only way that it was proven was that the guy hand wrote a note with his name, DL number,company name , license number of the truck, and their insurance company. The company at first refused to even listen to my husband, they were believing their employee. Finally they agreed to meet with my husband since he was persistent, along with the fact that the area and time where the accident took place was just where the employee was supposed to be at that time and place and he described the employee to a T. with all the information. My husband brought in the handwritten note to the meeting. Guess who skipped out of work that day and never returned. They ended up comparing the handwriting on the note to the job application. It matched perfectly. It didn't hurt that it included the DL number, which matched the one listed on his application.
