The fog lights are turned on by the BCM. If the BCM doesn't detect low beams (or parking lights) ON, it will not allow the fog lights to come on. And, when the BCM receives an input that the high beams are on, it won't allow the fog lights to come on.

 

I'm not sure how you'd get around this, though I don't doubt somone has found a way.
