When Will This Shiznit Be Over

Well the saga continues fellas! I finally was able to contact the Sales Associate for the builder today and asked her about my money ($2,000 Earnest Money + $3,045.25 deposit for upgrades) and she told me she spoke to the VP of Sales and he said we could have our Earnest Money back but he was not authorizing the refund of our deposit for the upgrades. She said I could call him if I had any questions. WELL OF COURSE I DID :rollin::D

 

I figured he would not answer his phone so I called from work just to be sure his caller ID didn't show my name. Anyway, the conversation started out pretty good (I kept my cool the whole time :D ). I asked him to please explain why he would not "authorize" the refund of my 25% deposit (I knew where he was going to go with his response.... :D ). He said, "We did not select the appliances and although they are nice, we may not be able to sell the house for enough to recoup the costs and we may even have to sell the house at a discount." HEY JACKA$$, IF YOU HAD DONE THAT IN THE FIRST PLACE YOU DIRTY BA*TA*D, YOU WOULDN'T BE IN THIS MESS RIGHT NOW WOULD YOU!!!! :D:dunno: I wanted to say that so bad but I didn't. I actually said, "So what you are saying is that you want to keep my money, even though when you do sell the house you will definitely get a modest return for those appliances and you are basically keeping my money to penalize me for something that was out of my control. Mister, we were ready to close on this house when the VA appraised it below your sales price. So I really don't see how that is fair that you penalize me for something I had no control over." I then told him, "So, since you are not going to give me back my money, AND since the total of my deposit was over $3,000, I guess I own one of those "nice" appliances so I will go ahead and let you select which I one go and pick up; either the Fridge or the Gas Stove." He immediately changed his tone and said, "Well, I guess we need to go ahead and make this professional so send me an e-mail requesting a refund and I will respond." My wife heard that and she immediately contacted the Fulton County Civil Courthouse and asked the Clerk what our options were. He told us to go ahead and send him the e-mail so when he refuses, we will have that correspondance. NOW IT'S JUDGE WAPNER TIME YOU SORRY BE-ATCHES!!!! By the way, I read through the contract and it specifically states..."Existing deposit(s) shall be refunded if the VA Certificate of Value is below the sales price of the home..." Well, that pretty much covers ALL OF THE F*$%ING MONEY THEY OWE ME! SEE YOU IN COURT YOU MOTHER

Sorry about that guys I just had to get that off my chest! I do feel better now. :lol: I am SOOOOOOO glad the VA took care of me. I already know that when this is over I plan on telling everyone I know not to use this builder for anything. So if you live in or around Atlanta (or are planning to) PM me and I will give you the low down on this company before you end up going through this same crap.

Glad to hear you should be getting your money and a little bit of satisfaction out of this mess. Guys like him will get theirs in the end. It's funny but it usually works out that way. **** him. :dunno:

:D:D I plan on getting them chromed and hanging them from my hitch like you see other guys' trucks! I guess this douche thought we were stupid or our inexperience with home buying would make us gullible so he figured he would take us for a ride. Dude my wife friggin blew up with the Sales Person on Friday and basically had the woman in tears. I have never seen my wife go off like that and not yell or cuss. I wished she would do that with me. :D

At least it sounds like you're getting your money back. I'd also see if you find a way to get them to cover court fees as well.

 

To quote Harold and Kumar, "The universe tends to unfold as it should", So these guys will get what's coming to them eventually.

I know they're just playing a game, hoping you'll back down, and they can keep your money. But, if they are REALLY concerned about "selling the house at a discount" ... just sell it to you at a discount!! But, like I said, they're just playing games, trying to get money for nuthin... and/or trying to get you to give in and get a more expensive loan, so they can make their money... while trying to find new ways to put the screws to you for "things taking so long" and whatever else...

 

Best of luck in court! Hopefully, it won't come to that...

I agree. Honestly, my wife said if they had come down on the price of the house, even half the amount that was under-appraised ($9,000), we still would've worked with them. Doing that would show us they were at least trying to work with us but I think greed got the best of them and in the end, it will cost them more. Now, they could drop the price of the house $30,000 and I still would walk away. Their loss not mine. They need to sell that house more than I need to buy it. The taxes they will have to pay until they sell that house will make them wish they had lowered the price and worked with us.

Thanks Blake. It's not often that folks wearing the uniform hear that and it makes what we do/did worth it. I am just glad there are groups like the VA around who actually take care of Vets and treat them like they deserve to be treated. Anyone who has endured what most military folks go through is number one in my book and I will always give my fellow brothers and sisters in uniform a hand if they need it. :dunno::lol:
