E-bay question:

the dealer failed, it looks, to take the car I'm getting off e-bay, and if  he auction goes to the end(a few hours left now), does the dealer HAVE to sell the car to e-bay guy? It dosen't look like the delear has a reserve, and the dealer would not take a deposit on the car.....so currently there is no legal "paper" bind......

 

looks like I'll be paying more, than the e-bay guy.....

 

I don't like this........ :crackup:(ignorant, maybe, but I don't get this similie)

now its WAY over what my agreed price was with the dealer, if anyone can answer, PLEASE HELP!!!!!!

I don't really know.  Looking back, it probably would have been wise to have something written up with the dealer, but your mind was occupied with a vintage Bimmer.  My response will put this thread back on the top and hopefully someone can help you out.

That stinks....

 

The dealer should have ended the auction when you agreed on a price.  Since he let it go, the auction is a "contract" with the highest bidder.  Unless the highest bidder is a "deadbeat" then I would say you aren't getting the BMW.

well, the dealer didn't knw that you couldn't end the auction within 12 hours of close. He tried to explain it to the e-bay buyer, the whole story, but said the e-bay guy's answer was "I'm an attorney for Oil Company, and THAT'S MY CAR." so the guy is having it delivered to Baton Rouge. The dealer says that he think they guy paid way too much for it, in his own opinion.  So the dealer feels really bad, cause he gave me his word, so he will use his "contacts"(this is a high end import place, remember) and he seems dead set on finding me another similiar car. :crackup:  :crackup:

 

But the dealer is doing what he can,and he's a nioce guy, so I'm not too anrgy about his mistake.

Just my few cents of advice here.

 

Don't ever think that ANY used car salesman is "a nice guy", or your friend.

 

No matter how well they treat you.

 

You are there to get what you want, at a reasonable price.  Not to make friends.

 

 

And I don't think it was a mistake. His job is to make the largest profit possible on BOTH ends of the transaction. Meaning that he has to try and rape the guy trading it in, and play you off of the EBAY bidders to see who comes up with the most cabbage. When he sells to an EBAY bidder, he doesn't have to put up with a customer picking apart every little ding, scratch, and smoke smell. He can also make money on the shipping fees.

 

Sorry, I just don't like salespeople. Every time I just talk to one, I need a shower.

He GAVE me the option of picking up the car today(and he would take the necessary heat), and I said if youir going to run into legal trouble, just keep it. he could have said "Sorry, I can't sell it, too bad", which who know, might have been what happened when I picked it up, but as for know, he's contacted some local  BMW shops(I know about the ones he's contacting) trying to locate me a similiar car by wednesday, and he seems confident he can do it. he dosen't have to do that.

To make money off of you. If you find it elsewhere on your own, he makes no commission.
