State Investigator Issues 15 Violations Upon 4WP

Federal law, specifically the Communications Decency Act, 47 U.S.C.A §230, states that websites are immune from any liability for statements Authored by others. I would like to personally like to thank the operators of this site. :cool:

 

The State Agency, “Bureau of Automotive Repair” has just completed their several month long “Fraud” investigation into the company known as 4 Wheel Parts Performance Centers, d.b.a. Transamerican Auto Parts Inc., d.b.a. TSI; resulting in the issuance of 15 violations. :D

 

This company operates 45 off-road stores nationwide, including but not limited to the selling of Factory Truck Warranties redeemable at all major nationwide dealerships along in being in the business of selling after-market parts & accessories on the internet and to dealerships nationwide.

 

However, there may be a serious conflict of interest issues with these warranties as 4WP mechanics are not GM/FORD/Daimler/Toyota/Nissan certified, nor retain the proper diagnostic equipment to give the complete required mechanical inspections, but they do anyway, and then sell these power-train warranties to be claimed at local dealerships.

 

In Addition, the title of 4WP’s, “No Questions Asked Tire Warranty” :chevy: has also caught the interest of multiple Federal & State regulating agencies for being, “False & Misleading” to consumers for the fact that the warranty does ask questions and allows 4WP to reject warranty claims at anytime.

 

President Gregory W. Adler of has vehemently denied any wrong doing to date and has stated via the internet that, “The customer is number one at 4 Wheel Parts.”

 

However, his statement completely contradicts his companies Better Business Bureau “Company Report” of a Grade/Score (D) and an (F) for his sister company, “Steel Horse Automotive.” A BBB Company Reliability Report on his companies can be obtained at www.bbb.org.

 

Furthermore, Mr. Gregory W. Adler's statement of, “The Customer is Number 1” is once again contradicted by the 15 Violations recently issued by the State Agency, “Bureau of Automotive Repair.”

 

This is just some of the following State Agencies final report violation subject matter below:

 

•Written False and Misleading Statements etc. Sections (17500 & 3370) BAR Laws & Regulations

 

•Failure to Provide Written and Revised Signed Estimates etc. (Bennett v Hays Act)

 

•Charging for Items Not Specifically Described etc.

 

•Installation of Non-Calibrated (Zero-Mile) Odometer, installed on factory leases.

 

•10 other violations were issued similar in nature

 

•Several severe crimes were committed; unfortunately no enforcement action was taken, due to the fact that there are no laws/regulations and/or introduced legislation for swift action to be taken.

 

•The State Investigator audited the annual “idler arm” sales records between a major dealership and 4 Wheel Parts. Service Manager stated (name withheld), “That after approximately (600) 1500 series idler arms were sold to 4 Wheel Parts, they began to return them for credit/exchange. Service Manager continued, “I know that you are not installing these parts on factory stock trucks, but installing them on trucks with larger wheels and tires that puts a huge strain/wear on these parts causing them to wear prematurely.

 

The service manager continued, “Not only am I going to stop crediting you these “idler arm” parts, I'm going to stop selling them to you altogether.” 4 Wheel Parts were purchasing factory stock parts and stating that they were Heavy Duty to handle the larger wheels and tires. The State Investigator elected to issue a violation in this matter.

 

Then the same service manager decided that it was a prudent choice to turn over several sensitive complaint documents to the 4 Wheel Parts Corporation. The dealership service manager, now in bed with 4 wheel parts made the improper effort to smear the reputation of the original complainant, when he was being interviewed by the State Investigator. The State Investigator elected to audit the annual sales records between 4 Wheel Parts and this dealership. This is just one of several audits that are expected to come in the near future.:eek:

The following fraud analysis was completed by an actual 4 Wheel Parts Employee, which was taken off the website RipoffReport.com.

 

No Questions Asked Tire Warranty is False & Misleading to Consumers...... Despite the Torrent of Consumer Complaints, 4WP Only Responds by Lowering Price By $50

 

 

Even though my company’s tire warranty clearly states,

(No Questions Asked,) the scam artists at our corporate headquarters specifically wrote it in for us to be able to do just that (Ask Questions) and deny claims at will.

 

Even though my company advertises, (No Questions Asked On & Off-Road Hazard Tire Protection Warranty,) my company’s contract specifically states, (Tires which have been run flat or abused will not be covered by the contract,) opening the door for us to ask questions. This allowed my manager to wrongfully reject several customer tire warranty claims.

 

Several of our customers rightfully argued and that our advertisement was, (False and Misleading) for the following reasons below:

 

1) No questions asked meant what it stated, (No Questions Asked regarding the tires,) or else change the tire warranty advertisement.

 

2) The title of the warranty, (No Questions Asked) contradicts the terms set forth of the tire warranty specifically, (Tires which have been (abused) will not be covered by the contract).

 

3) The contract FAILS to define specifics and limitations to the contractual word, “ABUSED.” It is common sense and fact that when a tire is taken off-road and exposed to the various elements, “It is abused by definition.” Furthermore, when a truck is stuck and wheel-spin is initiated for the truck to get out of this emergency

condition.

 

During this time, the tire experiences various ranges of heat and vibration, which is defined in the industry as extreme conditions and/or abuse. Another example might be emergency braking which is defined in the industry as extreme conditions and/or abuse on tires.

 

4) The tire warranty contract also (FAILS) to state for who is to make the final determination that a tire and/or tires have been abused, such as COOPER TIRE COMPANY or an independent entity.

 

5) FALSE AND MISLEADING DEFINED....In determining whether any advertisement, statement, or representation is false or misleading, it shall be considered considered in its entirety as it would be read or heard by a persons to whom it is designed to appeal. An advertisement, statement, or representation shall be considered to be false or misleading if it tends to deceive the public or impose upon credulous or ignorant persons.

 

Note: Authority cited sections 9882 and 9884.19 of the Business and Professions Code 9884.7(1)(a) and (h) and 17500 Business and Professions Code.

 

6) CONCLUSION: My ex-company has marketed an “On & Off-Road Tire Warranty that is clearly defined, (False and Misleading) to consumers by using the words, “No Questions Asked.” My ex-company has failed to fully define the word, (ABUSED) as it is a term used for exclusionary purposes of the tire warranty contract. In failing to define the word (abused), it can NO LONGER be applicable in the decision to whether or not honor a customers tire warranty. :

There also appears be serious conflict of interest issues with these EXTENDED WARRANTIES 4WP sells on trucks they lift. Many dealerships nationwide have recently refused to honor these warranties as 4WP mechanics are not GM/FORD/Daimler/Toyota/Nissan certified, nor retain the proper diagnostic equipment to give the complete required thourough mechanical diadnostic inspections, but they do anyway, and then sell these extended power-train warranties to be claimed not at 4WP, but at local dealerships. :wtf:

Thank you for saving us :wtf: I guess I should go and pull my pro comp lift off my truck and send it back :nopity: . I don't understand this warrenty thing though. If 4wheel parts was selling extended warrenties so that gm dealerships could fix your truck and 4wheel would pay for it. Who cares if thier mechanics were certified or not? If a idiot says my engine is ok, sells me a warrenty that they have to pay for and it goes kaboom 2 days later. Seems to me I could get a dealer installed new engine. Just like any extended warrenty around it is a secondary company paying for the repairs not GM (unless it is a GM warrenty). Why would chevy care unless the idiots who bought the warrenty expected GM to fix it free if 4 wheel declined to pay. I have voided my factory 36,000 by adding my lift. Or at least the engine trans diffs, cv axles , ball joints driveshafts, and a buch of other stuff. I knew it going in. Anyway 4wheel parts may have a bad rep on tires but so does firestone. Although 4 wheel shouldn't advertize no questions asked cause that is asking for trouble. Very stupid on thier part.

I agree. At the dealership, we could care less if someone certified it or not. If the extended warranty is paying for the repair, that's all we care about. Quite honestly, I don't know of any aftermarket extended warranties that do any sort of inspection/certification. All they want is your money for the policy. They'll try to find some excuse not to pay for the repairs when the time comes. :wtf:

NO 4HEEL PARTS MERELY SELLS THESE WARRANTIES, THAT ARE DEALERSHIP WARRANTIES Seems to me I could get a dealer installed new engine. Just like any extended warrenty around it is a secondary company paying for the repairs not GM (unless it is a GM warrenty). IT IS A GM WARRANTY AND 4 WHEEL PARTS PAYS FOR NOTHING, HONORS NOTHING.......4 WHEEL PARTS SELLS THESE EXTENDED WARRANTIES TO BE CLAIMED NOT AT 4WP, BUT AT ALL NATIONWIDE DEALERSHIPS.

 

Anyway 4wheel parts may have a bad rep on tires but so does firestone. IT WASN'T A FIRESTONE TIRE PROBLEM WITH THE ROLL-OVERS, THE SPECIFIC SUV CREATED A RESONANCE/VIBRATION THAT TRICKLED DOWN TO THE RIGHT REAR WHEEL IN MOST CASES.  VIBRATION OVER TIME CAUSES HEAT, HEAT CAUSES A BREAKDOWN/WEAR IN THE TIRE ETC.

 

Although 4 wheel shouldn't advertize no questions asked cause that is asking for trouble. Very stupid on thier part.  BINGO, YOU ARE CORRECT :cheers: IN YOUR STATEMENT/ANALYSIS, EVERYONE IN EVERY FORUM HAS RESPONDED THE SAME WAY.

 

 

 

I know you're sharp by the way you answered.......check this out....don't you think that BILLION dollar tire companies like Goodyear, BFG, Daimler Chrysler who hire the best & brightest couldn't come up with a [/b]NO QUESTIONS ASKED TIRE WARRANTY[/b]???? They didn't because it is FALSE & MISLEADING BY DEFINITION.

That's all well and good, but some people have great experiences with 4WheelParts. If the only reason you are here on this board is to bash 4WheelParts and post inflammatory topics about them, then you aren't going to be around very long.

actually those violations was the best thing that has happend to 4WP FOR CONSUMERS..........NO JOKE, THERE SERVICE HAS HAS COME FULL CIRCLE NATIONWIDE.............THEY ARE SPENDING A LOT OF MONEY ON IT. They are super nice to me on the phone etc, and people on the internet are saying the same thing about them.

 

The fact is, they can't afford to have this happen to them again, their insurance coverage for the next year will be through the roof.

    • I wonder what the price is out at the coast, Big Sur or other out of the way locations as I bet they are charging quite a premium over the in land pumps. 
    • Were you looking at the HD trucks on the GM website or the half tons as that makes all the difference. As far as I know there are only two options for the HD trucks and that is the standard 2 speed transfer case or the 2 speed transfer case that has the added 4 high auto feature and they put that transfer case by default into the LTZ and High Country although its optional in the LT and not sure if its available in the work trucks.    The half tons, that is where its been a total mess in my estimation for a few years now with most trucks below the top trim having the single speed transfer case as standard but with the option of having the two speed such as one would get by choosing the Z71 package, however then not being able to get the two speed transfer case with the towing package unless it was a higher trim truck AND had the 6.2 gas so one could combine the towing package gearing diffs with the two speed transfer case. Having said that if its a trail boss package then it gets the two speed transfer case but not necessarily able to get the tow package as it would depend on trim level and engine chosen. Believe me, people have bought the GM half tons assuming "of course it will have a two speed transfer case" only to find out after when they really pay attention to what they now own .... crap, there is NO low range !.    I don't believe Ford or Ram have gone that way yet with their half tons but like I say its been a few years now that GM has done this with the half tons.

    • My office is slowly filling with Blazer parts. Getting ready to do the big bang of repairs. Intake (second time), water pump, radiator, hoses, and I'm going to re-seal the timing cover where someone went hog wild with silicone. Might as well, because I don't think that's done right.   There's a local tow yard that I didn't realize also has quite the inventory of junk vehicles. This is an old school junkyard. No waivers. Cash only, you were never here if anyone asks. Don't piss off the owner, or you'll end up in the back of one of those cars, headed for the shredder. And if you see something, don't snitch. Cars stacked double high, wasps nests, trip hazards and junk everywhere. I found a few little odds/ends for my Blazer. The $20 I spent was worth the experience alone. But I was never there. What yard?   I officially love/hate this truck. It's so out of my wheelhouse, roughest vehicle I've ever owned. Every. single. repair. -is so hard-fought, everything that can go wrong, goes wrong. Currently in a hate phase, and kind of wish I was closer to sending it down the road with a lucky new owner, to be honest. Preparing for the day when I tear into this thing...lots of pre-funk with Ibuprofen.   Rock Auto sent me a bad reman rear wiper motor. It was a bear to install. The tailgate in these things has about eleventy-billion fastners and pieces and things that need to be uninstalled/moved just to access the shoddy rear wiper motor. The casing on mine was cracked clean through, btw. Nice, GM, nice. SO I got this new motor installed, hit the switch, I see it wig-wag (without the arm installed) and think I'm golden. Reassemble everything. With the wiper arm installed I gave it one final test. Time to clean up and take the other half out to dinner, collect a paycheck, right?   Nope. I hear the plastic worm gear stripping as the arm hung up. Just like my broken motor. Weak/old and shredding itself internally. I can assist the arm and the range of motion is normal, and it parks correctly. It just doesn't have the poop to actually sweep the arm with a blade on it. Oh, hell. Turned the key off and shut the shop door behind me. I get to do that over again, too.
    • A complete delete is the most thorough mechanical solution, but it is also major engine work. On a quiet truck that is still under extended warranty, opening the engine purely as prevention is difficult to justify. A plug-in disabler stops commanded cylinder deactivation, but it does not remove or repair the collapsible lifters, so it should not be treated as failure insurance. I would keep the oil full, document the maintenance, and have any persistent tick, misfire, or loss of power diagnosed promptly. If the engine eventually has to come apart, that is the logical time to compare an OEM-style repair with a complete delete. The right choice depends on the truck’s symptoms, warranty status, expected ownership period, and whether the engine already needs to be opened.
