I like an idiot bought a diablo predator on ebay and I got it yesterday and it is vin locked. Is there anything I can do such as contact diablo and have them unlock it, tune it etc...

Moral of this story is never buy a programmer from an individual off ebay! Too many scammers out there! Did you pay with PayPal? If so, I'd file a complaint with Ebay and PayPal. I'd also contact your credit card company, if you paid with a credit card, or have PayPal tied to a credit card, they may be able to reverse the charge!

The guy had very good feedback. I emailed him and he told me to send it back and he would refund my money. Also left his # for me to contact him.

It could be that he made an honest mistake and forgot to put the stock tune back in the truck. As long as the Predator Tune is in the truck, the Predator hand-held is locked to that VIN. I'm glad to hear the guy is trying to make it right for you, though. Best of luck!
