new bullitin out in canada yesterday datailing new procedure for catching guys using programmers on their diesels. all replairs relating to drivetrain must have programming history checked on scanner then compared to factory programming if even one matches warranty denial is virtually garanteed.

its easy to spot a program when you leave it in. return to stock and it shouldn't be a problem. i know diablo doesn't leave a trace, not sure about others.

i work for a dealer and of the half dozen units checked in the last two days three had programmers in them one was a bully dog dont know about the other two. i realize the option has been out there for gm for the last few years but they are now enforcing it. the service manager has to send the info including pictures of the scan data into a central office at gm. i wouldn't count on your programmers being undetectable.

with all the EPA emissions pressure and the fuel economy crunch there under I don't know they don't more aggressively tune the trucks from the factory. My 3500 DRW picked up fuel mileage when I put the superchips program in it. As a matter of fact I picked up about 4-6mpg depending on the fuel in it. Just don't make sense. Besides the fuel economy my transmission shifts a lil firmer and runs cooler less slippage in the torque converter less heat in the tranny. Not to say anything about the bigger pan and replacing that enemic transmission cooler they installed at the factory. just my opinion.

I am glad they are getting more aggressive on programmers and the like. It is not fair that some people blow their engines or blow out their injectors, and then expect GM to pay the bill.

 

I am one of the guys who usually buys used, so it makes me happy to hear this.

The Law

 

Federal law sets forth requirements for warranties and contains a number of provisions to prevent vehicle manufacturers, dealers and others from unjustly denying warranty coverage. With regard to aftermarket parts, the spirit of the law is that warranty coverage cannot be denied simply because such parts are present on the vehicle, or have been used (see Attachment A).The warranty coverage can be denied only if the aftermarket part caused the malfunction or damage for which warranty coverage is sought. Disputes in this area usually boil down to arguments over facts and technical opinions, rather than arguments over interpretations of the law.

 

:thumbs: Sounds like they have burden of proof to prove that the aftermarket part damaged the vehicle. With XXXk units sold DIV by number of claims = You have a pretty good argument that the aftermarket part did not damage your car.

There are changes in the PCM and TCM that occur when the programming is changed that can't be covered up. You can almost cover your tracks but not completely. The newer trucks are even hard to cover up. GM has only started to show the techs how to find it but it's been there for several years.

 

As for the Magnuson-Moss Act and warranty, sure, it says they can't void your warranty unless the add-on caused the damage but they can still block your warranty and then relax while you freak out and have to hire an attorney to undo the warranty block. GM has a lot of money to pay lawyers and plenty of time. Do you? You can't just go in and declare "I invoke Magnuson Moss!" and cause them to all scramble to undo the warranty block. They will just say, "ok" and walk away.

 

There is one guy on the Diesel Place that is 16 months into a fight with GM on a Duramax that blew that didn't even have a programmer but only gauges. Yep, 16 months with no truck. Can you afford that? Yes? Then invoke Magnuson-Moss when you are challenged with a warranty block. This guys argument is very valid that what he did had nothing to do with the failure but it's still been 16 months and counting with a dead truck.

That is reality folks. Few people can afford to fight it even with a tough stance.

 

Call it what you want but boosting the engine output isn't something GM should be expected to cover. You can argue that the 100 extra HP didn't cause the fuel injector to stick open and take out a piston but at some point GM does need to say "enough". They have been very clear over the last couple of years that they are no longer turning an blind eye to power boosting. If you buy a new truck and are considering doing this, don't cry when it all goes awry (right or wrong).

 

"Well I'll sue!" Yeah, and you might even win.

two vehicles at the dealership where i work have had their warranty put on hold while gm decides whether or not to cancel it altogether. the customers in question have both paid the bill for the repair. one bill was almost 8000 dollars.

Whoever paid the 8K dollar bill should have contacted a lawyer first.

one truck needed injectors and one truck needed a pump that had blown all three plugs out. also dealers are told to check and photograph the trans max torque on lmm engines. if the torque is over about 690 or so then a programmer has been in the unit at some point. i seen one with a max torque reading of 800 gm will more than likely deny warranty

This has been talked about on the HPTuners forum alot. There is also a counter in the PCM that counts each time the PCM tune has been changed. The update count has to match the number of updates a GM tech has done to your vehicle. So to load a hypertec tune and then remove it to have your vehicle serviced it shows up as 2 additional updates on the counter.
