Here is the scenerio:

 

Sunday night I was a succesful bidder for a 1971 Honda Trail70 Minibike with a Title.  

 

The seller didn't do a good job listing it and you had to do a pretty good search to find it.  Also the seller did not set a reserve.  I was the high bidder for $355 on a bike that is worth twice that much (maybe more).  Also the seller stated that he would ship the bike anywhere in the lower 48 states for $100.  I emailed him about the $100 shipping cost 3-4 days ago and he said that price was correct.  (I priced shipping out and it will be about double that price).

 

Now that the auction has ended he won't reply to any of my emails.  I have not sent any money either.

 

PayPal was an option at checkout and that is how I intended to pay the $455 total.

 

My gut feeling is that he knows he screwed up and doesn't want to let the bike go for that low $ figure and therefore he is not responding to my emails.

 

If I were to go ahead and Pay the $455 would that be a mistake?  Or would that force the hand and the sale back in my court?  How long should I wait and how long can I wait?  I don't want any negative feedback like "deadbeat bidder".

 

What do you think?

Pay for it like you are supposed to do and use a credit card.If he doesn't honor it you can get your money back from your card company.

 

Also,if he doesn't send the bike to you you can take legal action on him through ebay.There have been very few instances where this really ammounts to anything but you should uphold your end of the bargain and force his hand.

Wait for him to contact you first!  Yes the credit card payments are insured or covered by PayPal and eBay as far as fraud goes.  From what I discovered it takes over 4 months to get your money back if fradulent activity occurs!  This is because eBays SafeHarbor has to investigate the incident and try to make every effort to contact the said "fraudulent" seller.  Did the seller send you a PayPal or Billpoint invoice??  Also, he cant back out of a succesfully ended auction if the reserve was met!  If he tries to do that, I believe it would fall under one of their selling offenses as a Transaction non-performance.  If you want, contact eBays SafeHarbor and give them the lowdown of whats going on.  Heres the SafeHarbor page http://pages.ebay.com/help/community/index.html

I believe the card I have registered with PayPal is a VISA Platinum Card from MBNA (with Dale Earnhardt on it ) .  Does it matter if it is VISA or MasterCard?  Do both offer moneyback buyer protection even in auctions?

 

Generally how long do I have before I need to make the payment?

 

This seller wants PayPal or a money order...

 

(If he'd return my emails then I'd be happy...)

As far as I can tell the "safe harbour" will only recover $200 minus a $25 transaction fee, so I'd be out over $250.

 

The seller had chosen PayPal as checkout probably when he listed the item.

 

When the email came from Ebay that I was the successful high bidder, it gave me the option to "checkout" with PayPal immediatly.

If I were in your shoes, I wouldnt pay him a dime till I got some type of correspondance from the seller.  Just try to send him a few more messages.  If he doesnt respond to you, email eBay.  I think you have to wait a while before you can file a complaint with ebay.  Does he have any negative feedback at all??

If he has sent you any kind of payment info or guided you to the checkout area then he has,in ebay's eyes,attempted to finalize the auction.

 

He may well be trying to get out of giving you the bike for that final price but if he has put the ball in your court you have to respond according to ebay's user agreement.

He has 53 comments in his feedback.  All are positive except for one neutral.  I believe the neutral one was that the buyer didn't feel he got an item that was as nice as he had hoped.

 

It does appear that VISA has a 0% liabillty.  But the problem I see is that VISA pays PayPal and then PayPal credits the seller.

 

I don't want to let this bike slip away because I didn't pay in a timely manner.  I feel bad the person is going to lose alot of money on the deal...  but that is what the Ebay "game" is all about, right?

I talked to my "cousin-in-law" who is a big ebayer!!!  He actually makes alot of money buying and selling old toys (especially StarWars stuff).

 

He told me to wait a few days and then pay for the bike.  He said that since the PayPal "checkout" was emailed to me it is a binding contract.  He also felt that between the PayPal/Ebay "Safety Harbour" and my VISA card that the most I will get out of it is a headache trying to recover my funds.

 

He said Ebay is becoming very good at showing liabillities and will back the "buyer" (in my case) 100% until the arbitration (if any) is resolved.

 

I think I will send the money in another 24 hours, even if the guy doesn't respond to my emails.  My cousin-in-law also felt that this ebayer is probably ignoring my emails in order to make me the scapegoat on the deal...  That way he won't take a big loss on his f-up.

I would add to make a hard copy of all e-mails sent and all received form him along with a copy of the item and description.  You would hate to have your puter take a dump on you and all of your records would be gone!!!  This is experience talking, here.  It's a long story but thank goodness my wife is one who makes a copy of everything it saved us about $400.00 on a deal that went bad.

I see you found another one.  Didn't want to share this deal huh? I got your posts on these bikes before and been checking them out also.  I decided to start the other project anyways.

 

 

Check with Paypal to see if the seller is a "verified seller" meaning he has done cc transactions before with Paypal. Also paypal recommends contacting paypal prior to sending payment if there is any suspicion.

 

Paypal is now an eBay company, so that could help too. Lots of info on buyer protection on paypal's website.

I've never had a negative experience on eBay as a buyer! Other than maybe shipping damage. BUT I have had plenty of high bidders back out with second thoughts. May have happened like you said thought he would get more and now is trying to hide.

Shaners, you're right that one was a little hard to find. I missed that one.  And as a stay-home dad I tend to spend a lot of time on eBay!

 

Also, I believe you can request seller info on eBay. It will swap your info to him and his to you via email. This will give a phone number if one has been listed. Very many are!

 

Everything seems legit on the auciton.

He also sold a bunch in the past with positive comments.

 

I hope again it works out,  its only been a few days. I've found some people only check emails every few days or only at work etc.  Although you'd think after selling an item you'd check!

OK, I finally got an email from him after sending my last 2 emails requesting a reciept.

 

This is what he says...

 

 I can't accept credit card payments through paypal, so if your payment is a transfer from your account that will be fine, otherwise, you'll need to send a cashier's check or money order to:

 

He did send me an address and phone number and his user ID is the same as his email address.   [email protected]

 

The phone number he sent is different than the one he had listed with Ebay when he registered in 1999.  That is understandable and explains why when I called that listed number it came back as no longer in service.

 

How does PayPal work if he cannot accept creditcard payments?  I have not "verified" my PayPay acct yet, meaning I still haven't given PayPal my checking acct number and I'm still buying with the $2000 limit they established when I signed up for PayPal.

 

It looks like I'm getting somewhere now, but any more info or suggestions you guys have is greatly appreciated.

 

And Karl (Knuts), I saw a minibike frame and motor on Ebay a few days ago.  You could also check out the Honda Z50 bikes.  They can sell for alot less than the CT70 bikes.

      Mine just keeps lagging or getting stuck on the reverse camera. When I turn off the truck, get out, and close the door it will still stay on. It’s very intermittent and I would not be able to duplicate the issue.

      I was checking out fuel prices at my farm fuel retailer at their pumps and yes the farm price is a bit lower than the non dyed fuel and was glad to see that the regular farm gas price has dropped a lot from what it had been but what blew me away was the price of diesel as the spread now compared to before the prices went up earlier in the year, diesel was actually slightly lower than gas which was a switch from the theme the last number of years. However that sure isn't the theme lately and definitely not right now. The prices I will post are not from that retailer but just looking at gasbuddy for the main city in this area and instead of posting the lowest price someone found I will list the higher price ( and that may not be the highest price, just whatever someone posted on gasbuddy ).   So regular gas and there are a lot of stations listing the same price for regular is 1.68 a liter, premium 2.00 a liter. Diesel 2.03 a liter for a top price I saw on diesel.   Figures out to 6.36 a us gallon Canadian funds for regular and 7.68 for diesel. With the US exchange rate it would be 4.58 us for regular and 5.53 for diesel.    Thought I would figure that out to get a picture of what it settles out like compared to various US prices and its about the same as the current price in Fairbanks AK as Anchorage tends to be lower. So yes, these would be the prices and higher along the way on the Alaska highway where they know they have a captured market !, for fuel prices for those beginning the long drive back to the lower 48   The problem is our Canadian dollar and going to the states that have the high prices, boy do we pay then !

      Just wanted to get a idea of how many of you still have problems with your radio cutting out during the first few minutes of driving, my 2024 GMC Sierra still does this after a little over 2 years of complaining to my dealer about it, and OTA updates no longer complete, the check for updates in settings is greyed out for the second time while trying to install a update, my dealer took about a week to play around with it the first time this happened, and somehow got the check for updates to work, even though it would always show system is up to date when I knew it wasn't, now again 1 month later its greyed out again when the OTA update N25-F163BU tried to install, which ironically is the update to help with reliability of future updates.

      Prices on the hi-way are falling daily, $3.66- $3.71, Local has yet to drop, actually some are still going up, $3.87 and up
