L.A. Court to Decide on Copyright Suit

LOS ANGELES (AP) - A federal judge considering an Internet copyright case said Monday he was inclined to allow U.S. record companies and movie studios to sue the Australia-based parent company of Kazaa, a popular online file-swapping service.

 

 

 

Judge Stephen Wilson heard arguments on whether Sharman Networks, which is headquartered in Australia and incorporated in the Pacific Island nation of Vanuatu, is subject to U.S. copyright laws.

 

 

"It is a difficult question, but it has to be resolved," Wilson said. "The court will do its best to resolve it promptly."

 

 

Although Wilson did not indicate when he plans to issue a ruling, he appeared to tip his hand, noting that he "would be inclined to find there's jurisdiction against Sharman."

 

 

"I find the argument about providing the service to so many California residents compelling," Wilson said, referring to the plaintiffs' claims that Kazaa provides free access to copyrighted music and films to some 21 million users in the United States.

 

 

The case is one of the largest in the recent copyright wars testing the international reach of U.S. courts. If the judge decides Sharman can be sued, the company would be thrust into the same legal predicament that have stymied popular online music services such as Napster (news - web sites) and Aimster.

 

 

David Casselman, an attorney representing Sharman, said holding the online swapping company liable for copyright violations would be akin to prosecuting a computer manufacturer for the actions of computer hackers.

 

 

David Kendall, an attorney representing six movie studios, including Disney, Fox and Paramount, said the fact that Sharman's product is available in this country is sufficient cause to face trial in a U.S. court.

 

 

"It does not violate due process to have them stand here to answer for their conduct," Kendall said.

 

 

Sharman attorney Rod Dorman countered that such a move could open a door for a judge in "communist China" to rule against U.S. companies that operate online. The judge did not appeared swayed by the argument.

 

 

"I'll take my chances with that judge in communist China," Wilson quipped.

 

Carey Ramos, an attorney representing song writers and music publishers, said the judge's comments would send a message to those companies seeking to operate offshore.

 

"This is important because it shows that you cannot escape U.S. justice by setting up shop outside the United States," Ramos said.

I never got WinMX to work as good as Kazaa.  For me the download speeds were terrible, if they started downloading at all.  We'll be needing a good alternate soon I'm afraid.  Kazaa won't last forever.   :chevy:

Once you have 2.0 on a PC, the only way to rid yourself of it is fdisk,format,reinstall! :chevy:

I can never seem to get any of the download sites to work. I always thought Audiogalaxy rocked. I filled up 15 CD's with mp3 files before they crapped out. When you are running (2) full T1's to the internet download time is only limited by the other end.

 WURD!  WinMX 3.3 is pretty good, but it will freeze the computer when it first starts up, just for a minute or so.  Most of the DL's are pretty fast, at least with cable.

I have version 1.7.1    Do I have spyware also? Can I uninstall easily?

I thought that there couldnt be anything done with a P2P client if it was decentralized??  Napster I believe was centralized because you had to sign in to a server.  Is Kazaa even decentralized??  Im asuming WinMX is a true P2P client.  I figured the day would come when some greedy suits in Cali would attack Kazaa!!

I was beginning to think I was the only one who had problems with WinMX.  Tried it on the recommendation of some people here, but it rarely worked for me.  Downloads took forever as well, even with my cable connection.

 

btw, I agree with whoever said that Audiogalaxy rocked.  Haven't got anything that works as good for me since they shut it down.

I know this sounds stupid, but what is spyware, what does it do?

 

Also, try Blubster I know I already posted this, but I forgot which post it was on. It is great, incredible download times too! The only downside is you can only get music off of it, there are no movies, or video clips:(

    • The filtering to wear relationship goes like this:      'Relative Engine Life "Factor" new divided by the factor old. So 8/3= 2.67. That result is the multiplier thus if a motor had an effective life of 100K using a filter with a 45 micron rating at a Beta ratio of 75 then a filter with a micron rating of 10 at a Beta of 75 would improve expected engine life to 267,000 miles.    Wear metals are an indirect indicator. Less is better and the motor lives longer but there isn't a multiplier like there is for filtration so well documented. Most of that has to do with the sensitivity of the wear metals tests themselves. The read a 'slice' of the spectrum but not the absolute values for the entire spectrum. So a general indicator that is used WITH the results of other tests. Two others considered in this post.    There is also the influence of corrosive wear which may be seen in the wear metals but separate from load based or viscosity mitigated indication. It's a small graph but the gray line is wear vs the TBN/TAN crossover. Not as useful as it used to be as there are now new chemistries for acid remediation that don't show up in standard UAO testing. They will catch up or be found liars. Only two possible outcomes, eh?             
    • One thing that comes up over and over is that the torque converters are the weak link. Many of the failed transmissions have the same thing in common. The torque converter grenades and then metal torque converter shards end up destroying the transmission. One of the best things you can do is if your transmission is still fully functional, change out to one of the aftermarket billet torque converters. There are several good choices mentioned in different threads here to make your choice. After that, then you can decide about trans tuning. My trans failed at around 95,000 miles. It got replaced under the GM protection plan. The remanufactured trans comes with a 100,000 mile /3 year warranty. I still have just under 1 year left. So far, so good. As long as it's still working good next year, an aftermarket torque converter is going to get installed early spring. If the trans and OEM torque converter fail by then, I will get it replaced under warranty and immediately have an aftermarket torque converter installed. A warranty replacement trans of a replacement trans will no longer have the warranty so I will bulletproof it from the get go.

    • I really appreciate the response.  I guess I was confused about torque angle vs torque angle yield.  The individual bolts don't have a warning on reuse but the part number for the LCA nuts does.   Regarding the purpose of the moog grease fittings on their bolts .. Guessing to reduce possibility of corrosion locking the cams or seizing to the bushing inserts.
