Faulty Airbag 1 My Knee 0

Last week my grandparents and I were in an accident with a UPS truck totaling his 2008 Silverado WT. The UPS truck made a left hand turn in front of us and there was nothing we could do. However my airbag (I was the passenger) didn't deploy and GM is investigating. My knee got messed up but everyone walked/hobbled away! Just figured I'd post, hopefully GM comes out with a fix to prevent anyone else from being injured! I'm recovering no break or tears just some serious fluid and swelling on the knee preventing it from bending etc.

This airbag was affected by the recall batch, for some reason his truck was yet to have a fix available. He was notified in July of the recall and threat there was no fix yet. It did however say the vehicle is safe to drive. Well in the event you're a passenger it's not safe to ride if you have an accident.

Glad everyone walked away. Your seat belt saved your life. Take care of that knee and I would advise you not to sign anything from an insurance company or GM nor cashing any check from them without at least speaking to a competent attorney.

This accident is different from most MVAs with injuries in that you've got both an at-fault commercial vehicle and a products liability angle from the faulty airbag as well. You'll want to seek out an attorney experienced in handling both commercial vehicle accidents AND products liability cases. This is generally NOT the guy with his face plastered on billboards all over town. avvo.com and lawyers.com are both good places to research lawyers in your area.

I'm not saying that you have to or even should sue somebody over this, but it would behoove you to seek legal counsel before signing anything. For example, you want to make for sure you're covered for any future problems you may have with the knee. Many personal injury attorneys will not charge you a fee for an initial consult, so all it costs you is an hour of your time to make sure your tail is covered.
