Wow that sucks

 

Diminished value is pretty straight forward why they are making you prove that is ridiculous. Maybe get a trade in report from a dealer on your truck have them do it do no damage and post damage repair

The fact it's wrecked = automatic diminished value. The fact your airbag deployed = even higher impact of diminished value.

 

As Ryan said above, get your dealer to do a report based on the truck being repaired following the acident vs. if the accident never happened. I personally would go ahead and get a lawyer and quit talking to the insurance company. You're fighting an uphill battle that's only going to make you more and more frustrated (at the very least [emoji6] )

Update

 

It took the adjuster 8 days to come and look at it for the supplement, New York law said he had to be there within 4 days. Long story short they refuse to total my truck, its's now up to $25k in repairs. The insurance company is also saying that my truck doesn't have any diminish value but if it need have diminished value i would have to prove it. I asked how they want me to prove it and that won't say, so I'm going to have to get a lawyer. I'm also going to file a complaint with New York States Department of Financial Services. I'm pretty sure insurance people are some of the worst people alive after dealing with them for the last month.

 

I am curious if you are working only with the other party's adjuster or if you have involved your insurance company.

 

I have always worked exclusively with my insurance company and had much better success than it seems you are having..

Already tried that my insurance Geico was worse to deal with than the other party's insurance. My Geico policy is up in August and I will not be renewing with them.

I went through the same process of trying to get diminished value after my truck was rear ended two months after I purchased it knew. NY state does not require insurance companies to pay diminished value. I tired going to many different dealers to get my truck appraised and no one would give me an actual number to prove diminished value. They all said the same thing, as long as it's fixed it shouldn't really affect value, which we all no is a huge load of BS. I have three years to try and prove diminished value to the insurance because I told the other drivers insurance I was going to file a claim, and they told me I had a three year claim window.
