2015 Silverado Accident

Just an Update:

The insurance adjuster only came up with a $19k estimate. The claims examiner is heavily pressuring me into taking the check for $19k without giving my body shop time to look at it. So the truck is at the body shop getting torn apart. It's really annoying, just a quick pass over of the truck with the body shop turned up at least a dozen things the adjuster missed and that was without taking anything apart. I'm in New York so I'll look into contacting the Department of Insurance. I'm also drafting a letter for diminished value.

Here is an article about New York auto settlements.

Fight for what you deserve which is a complete replacement imo with that amount of damage and do not listen to the people on here telling you it wont happen and fixing it is fine, the value of your truck regardless of how well it is fixed is compromised and will never be as good as a truck that was not in a severe accident like yours has now been in.

Put it this way if you were in the market to buy a truck and you ran the car fax on your truck and seen it was nearly completely rebuilt, would you pass it over and look at the other 13283764276377 gm trucks on the market or would you pay full price for your repaired one? Don't take anything from the insurance company until you are 100% satisfied!

I'm trying to get them to total, but getting nothing but push back from the examiner to take the $19k "settlement". She even told me that I was procrastinating. Not really sure what to do at this point, I really don't want a 4 month old totaled truck back. Anyone think I would have a better chance going through my insurance and having them fight it for me?

On a side note when walking around my truck at the body I noticed that the passenger side front was tilted inwards at the top, not sure if that's from the frame being bent or the suspension. Also noticed what I think was the transmission cooler bent into crank shaft pulley, not sure if that caused any damage.

Does anyone know if I have the right to refuse to have them repair and blend the passenger door a-pillar and make them replace them with new ones?

Id talk to some lawyers in your area so you can be fully aware of your rights.

You can probably get a free consultation from a lawyer, they might be able to get you more, but they will want a piece of the pie

Edit: now is probably the time to say your neck is starting to ache

I'm not really the lawyer type but after the pushiness of the claims examiner I did contact a family friend that's a lawyer and he told me not to accept anything less than a total loss. I've sent a strongly worded letter explaining my position and hope I don't have to pursue any further conversations with lawyers.

Stop by to look at my truck again today, it still hasn't been taken apart I've attached a picture of the negative camber on the front tire now, not sure if its from the bent frame or if the suspension is bent. The red F-250 is the rental they gave me, I'm not very happy about driving it.

The body shop finished the tear down on Friday and came up with another $4k worth of damage and they said that there is still more the haven't uncovered yet. The adjuster still has to come out and look at it again. The body shop informed me that if they do continue with the repairs I'll be without my truck for another 5-7 weeks between waiting for the frame and the repairs. Not very happy about being out my truck for 8-10 weeks considering I only owned it for 16 weeks before the accident. I've also sent the insurance company a letter for diminished value. Hopefully between diminished value and the cost of repairs they will deem it a total loss. I'll give another update in a day or 2, hopefully it will be resolved by then.

Wow can't believe you have to work so hard to get results from the insurance... It was a 4 month old truck you deserve a 4 month old truck. Not a totaled 6 month old truck.

Apparently the adjuster has been sick all week, so he still hasn't went back out to look at my truck. The body shop was told by insurance company that someone will will definitely be out to look at it on Monday. The body shop also came up with a lot more damage since the first supplement they submitted. They are not sure if anything is wrong mechanically, OnStar shut my truck truck at the accident and it hasn't been started since. Hopefully Monday I'll know if it's getting totaled.

Update

It took the adjuster 8 days to come and look at it for the supplement, New York law said he had to be there within 4 days. Long story short they refuse to total my truck, its's now up to $25k in repairs. The insurance company is also saying that my truck doesn't have any diminish value but if it need have diminished value i would have to prove it. I asked how they want me to prove it and that won't say, so I'm going to have to get a lawyer. I'm also going to file a complaint with New York States Department of Financial Services. I'm pretty sure insurance people are some of the worst people alive after dealing with them for the last month.

    • Diesel or gas?  The 37s will obviously, drastically reduce mpg, but the gasser will take a bigger hit to mpg, and power.    I wouldn't sweat a gear change on a duramax at all, and unlikely on the gasser either. You're obviously not concerned with acceleration or towing, and the 10spd will find itself in the right gear without much hunting, if any.
    • I understand. It is disturbing to think a manufacture asks so much and gives so little in engineering support. This is not a GM issues, this is a greed issue and one the ALL practice.    My intent was not to remove the wind from anyone's sail but rather to point out the areas deficient so that they can be discussed with improvements the goal. But to do that you have to know the truth and what that truth is.    The commercial interest are honed in on a few select issues in which they control all the variables and are not forthcoming in the least with their customers about the details. Failure is the only thing that drives these people to improvement. One way not to fail it to manage public "expectations". The set a bar they can clear and put their thumbs under the suspenders with chest puffed.... Only the internal data tells the story fully. As we don't have access to that for decades then we have to generate it ourselves. UOA's with data that matters.
    • I had skimmed through that article when you posted the link and honestly I felt rather defeated in a sense and realized that all these years in changing oil that in fact putting in what I was told was a good quality oil was probably not filtered as well as it should be although the filter put on the engine would be what ( as long as it never went into bypass mode ) would be the final filtering of the new oil that the engine components would first see, but then the filtering media itself is not up to par to what is ideal because a full flow filter would be too restrictive to filter fine enough for the engines best outcome in the long run. Only one of our tractors over the years which was a Versatile with a 855 Cummins had a separate bypass filter, some engine manufacturers did spec a partial bypass system within the main oil filter but I don't believe any other trucks or equipment I was servicing used such a filter. No doubt a product like the Amsoil bypass system is of benefit as long as nothing goes sideways with the extra plumbing and filter such as a rupture/leak that could cause the oil to pump out of the engine ( yes that Versatile had a remote canister with hoses routed to it as well ). With the idiot egr system on a diesel and as a result forcing a lot more soot into the oil, that certainly isn't helping the diesel engines cause or as you pointed out the GDI engine issue with creating more soot and aside from having a fancy secondary filtering system, changing the oil more often helping lower the total soot load.     So oil manufacturing and the end product is not something one can control and I wonder if there are specs on what various oil packaging companies produce in particle count or size. As to the filtering, if the OEM is not designing a filter size and spec that is really what it could be, they too are short changing the end user and so what is the answer. Of course as you say the oil side can only do so much if the air side isn't keeping up its end of the picture and air filters are only so efficient and if in a dusty environment such as farm or construction or driving gravel roads there is a lot of dirt to filter out and some of that ends up into the air stream.    Of course the irony in places like where I am where they dump the salt on the highways but also will mix in some calcium or outright pure calcium for problem road area's, or using calcium as dust control on gravel roads, the vehicle that gets used in that environment may rust out before a properly engineered engine and maintenance finally wears out so one has to face that reality in the rust belt.
    • Has anyone run these on their 2500?
    • have you stuck with dealer oil changes since then? I made the same switch after getting tired of crawling around under the truck, but I’ve found some dealers are way better than others about getting you in quickly. Curious if yours has been good about scheduling or if you’ve had to look elsewhere for quicker turnaround.
