Question About Selling Homes.

Soooo....My house has been sold, and we've got to out of here in a little over a week...We're packing everything up.

I've got some pretty nice curtains in the house that my mother made for me for Christmas...And my real estate agent is telling me that they stay.

WTF? Is that normal? Every window in the house has 2" wood blinds on it, why in the hell would I leave expensive ass curtains for somebody that didn't pay for them? Seriously...Just the fabric on these things cost me over a grand and a half. If I'd have paid a curtain maker (whatever they're called), I'd be twice that into "window treatments".

I'd not normally care that much, but my mother made them....And they'd fit several of the windows on the new place.

Anyway, that's it for the venting. Those of you that sold a house or bought one (I've only bought one house, and it was brand new)....What about the "window treatments"? Did you leave them? Did the seller?

Window treatments, other than custom sized/permanently mounted blinds, such as curtains are typically negotiated in the purchase agreement. But if you didn't state that the curtains are not included, the buyer can insist that they stay or back out of the purchase agreement.

Always make sure you make clear the items which you intend to keep that are attached in any way to the house. When I sold my last house I made sure to tell the agent that the surround speakers that were mounted to the walls/ceiling in the basement were NOT included.

Got to agree with CC here...specifics need to be laid out in the purchase agreement including what stays or can be removed from the house. You might be able to visit with the buyer concerning the curtains after the fact, either outright purchase and/or additional $$ towards replacement installation. The buyer is not obligated to do anything, tho.

Thanks guys.

Shit.

Anything "attached" to the house is typically considered part of it.

Looks like you are going to have to buy some new magnolia blossom drapes! :smoker:

EDIT: BTW, Congrats man!

When I bought this place, there was ONE ROOM that had curtains in it. (All rooms had 2" wood blinds.) When I got the contract, they explicitly said "curtains in front bedroom do not stay!" I asked my agnet "WTF would I want those things for anyway!? The BLINDS all stay, right!?"

She said it was "normal" for people to expect that any window treatments stayed, whether the buyer requested that they stay or not. So, it wasn't unusual that the seller put that in the contract.

Best of luck working something out! :smoker:

I asked my mom ( shes vice president of some real estate company), It is customary to leave the blinds but not the curtains, unless specificly stated in the contract. However, if it means losing the sale, let them have them.

Id talk to the buyer first. Real estate agents are just as tricky as used car salesmen. Trust me, Ive known one all my life.

IF you can get TO the buyer. When I bought this place, I sometimes felt like that agents were the ones doing all the posturing and making things more difficult.

Mike : Have you guys already closed on the deal?

Does that mean you have to leave all the pictures?

I took mine. Those things are exspensive. But it was never mentioned one way or another.

Look at your sales contract and the addendum. Read the fine print.

See if it says one way or the other if they are supposed to stay.

I have bought and sold a "LOT" of houses and blinds usually stay...curtains/drapes were always negotiable. bUt that was in Texas..OK may be different.

If it does not say..either way...take them and tell the buyer "Tough $h!t...sue me."

I'd try to talk to the new owners, tell them that they mean a lot to you since your Mother made them, and see if they'll let you keep them. :smoker:

You could also tell them that your dog liked to use them as a piss rag...

+1 on everything, but especially on the bold part.

Read your contract! There is usually a clause stating the disposition of incidentals.

Once you have signed an agreement with a real estate agent, they will try to isolate you from buyers (don't know if its legal or not).

You could go to Lowes, buy cheap blinds, and swap them out and see if anyone says anything.

Odds are, it is in the paperwork somewhere. You could ask your realtor to show you where.
