2018 Tailgate latch repeatedly breaking

I've had to get the dealer to fix my tailgate latch three times. Each time I couldn't open the tailgate. It would unlock and I could pull on the latch, but the tailgate wouldn't open.

 

I have a cap on the bed, and the last time this happened I had furniture in the bed that I couldn't take out without taking the cap off. The dealer this last time wasn't my local dealer, since I was delivering the furniture to a place about 200mi away from home. That dealer wasn't prepared to do a replacement, but did do the repair. They said that it should be replaced under warranty when I got back home. However, my local dealer said that they couldn't replace it unless it was "currently failing", even though one of the times that it had to be fixed was at their dealership just a couple months before. 

 

I'm still under warranty, and not happy with how this is being treated by GM.

Did they say what they fixed? it is very easy to replace the handle, or you can just take of the access panel on the tail gate and see for yourself what is going on.

might be a retainer clip on a push rod link.. 

does the easy drop  tailgate still work?
