I just bought a used 09 Malibu LTZ and the dealer in MA did not charged me enough for the reg and tax in NY so he came out of pocket for 450 and is telling me that I have to pay. I will pay if that is my only recourse but if the contracts were signed and there are no stipulations that that I would have to pay any additional fees am I responsible and if so why.. I have a call into a couple of lawyers to see the true legal side.. But I was wondering if anyone here maybe had an Idea.. thanks

From what i know of dealers,,,,,, if it's signed contract then it's final. Screw them, they can easily come up w/ the 450,,, that's a service job, and a detail service.. Enjoy your car!!!!!!

I think you need to pay. They have 3 days to cancel contract too :lol: Besides, it's just bad carma if you don't, especially knowing you needed to pay it.

I agree, but screw them now and they may screw you later on some work you have done. Might cost you a lot more in parts and labor later on. And if you do get into a legal battle, then lawyer fees will cost you more than $450.

I agree. If you refuse to pay, good luck ever getting any service from them or any dealer in your area.

These are TAXES not FEES. The dealer collects the tax for the State. That's who you owe that amount to. I believe you'll find that you will need to pay up.

 

My vote is do what's right. You know what taxes are in your area and how much you would owe.

Dealers do not charge tax, they collect it. If you have not paid tax, YOU are liable for it.

This is a very common issue when buying out of state. The dealer often times is estimating the taxes. Most will try to over estimate. What if that were the case here and they over estimated your taxes by 450? Should the dealer just keep it?

 

This happened recently to my parents. They bought a vehicle here in TX and the dealer over estimated the OK tax rate by about 500. They sent a check to my parents for the extra amount.

You know normally I would just pay this bill and move on, but once the deal was signed and the deal the dealer hands me the key with only one key fob and tells me that he can't give me a second one. because its a used car and doesn't have one.. then I told the sales person to make sure there were mats in the car and of course when he delivered the car to me there were no mats and nobody remembers me telling them about the mats.. So i am not interested in being dishonest or lying but i held to my part of the contract and did all that was asked of.. now this idiot screw up and wants more money.. My attitude is a result of him treating me like crap after he gets his signature.. THEY ONLY WAY I am giving him the money is if I am bound by law to do it.. Every lawyer and the MA attorney general state that a contract is a contract and that is the legal responsibility i am bound by.. So please do take this as some one trying to screw over the "poor ole' dealer" just trying to get by.. this guy was an A$$ after he got the deal and while i believe i made a good deal the extra money required for the mats and the key fob is ticking me off.. it would have been a small expense on his part to make a customer happy but instead he took the dirt bag route.. and now he needs me to fix his mistake..

I think the misatke was made because the car was bought from another dealer in another state, correct? I don tthink you are legally responsible. I would maybe pay up after they get your key fob and mats and certainly not before. I would negotiate that calmly with them. If they didn t want to give what they promised tell them when they sue you you ll bring up the counter claim. I had to make a complaint with NJ AG s office when I bought my 08 Mailbu and I stuck it to them. They sold me a damaged car that was hit bad (new car) and AG s office made them get me a new one and reimburse me $1500 after they tried to jack the replacement car price cause it stickered for more. I d take it for service somewhere else anyway after seeing how incompetent they are. If it s less than three days tell them you want out and then they ll deal :D . I am an honest guy but I am sick with all the complaints and dirty stuff I found out when researching my case about some dealers. Don t be so quick to bend over.

PS/ Good luck getting your plates and title if you dont have them already. Something else to consider. Take it back and take over my 08 LTZ lease, I only have 15 K on the car. Good Luck, keep us posted.

if i am reading this right, bought a car in MA. paid taxes on MA sales tax% . was the car registered in MA? in your name? if so NY is going to want there sales tax when you register it. i think YOU are going to pay the difference in the tax.

Mistakes made in taxation receipt are ALWAYS the responsibility of the buyer. Every state in the union is the same on that point. If tax was not collected (no matter where) the buyer is liable for it and it will have to be paid.

 

There really isn't any legal wiggle room here.

If I was you I would just file a complaint with MA. consumers affairs (state agency) and see how many times they did this. It a good way they can mislead you in your total price to close a sale.

      My 2015 1500 LTZ Silverado suddenly won't go into 4 x 4 low. It will go into 4 x 4 high.

      Yep, just a quick reference point.    My main point being I’d do a thousand other things before I’d pay 10k for a transmission.    Speaking in ignorance cause I don’t look at these trucks, what is it worth? 20k?

      I think users are going to want to pick their monitored parameters, which parameters they want to see first.    It should probably start with baseline at a minimum and adjust to learned, but be able to overlay baseline for comparison.   A simple severity level would be able to determine what type of alerting is appropriate or user selectable.    Why not use the OBD port though?   I think a phone connection would be a good idea, push notifications type deal.   Number 1 issue is having data is useless if you don’t know what the data should be under normal conditions.

      I thought I would use your thread and add to it as I just did my first longer drive with my truck in the last couple of days. I drove from the Grande Prairie area of Alberta down to Edmonton and most of where I drove in the city was the ring road so fairly free flowing but a bit of stop and go as well in the city. Stayed the night and returned home and not too many stops along the way each way but every restart and certainly every cold start sets it back for fuel mileage. Why I say that is I see some people will cherry pick a fuel mileage leg after the vehicle had been warmed up driveline wise before hand and its a forgiving ( easy rolling drive leg for example ) and call that their fuel mileage which can give a false perception of reality. I was not heavily loaded at all but never the less the flip bak cover, rubber bed mat, various tools etc and extra jerry cans of fuel all way up to a few hundred pounds of dead weight so its not an empty truck. The cold inflation tire pressures are set more near the freezing point so once they are warmed up driving I was showing 45 front and over 40 rear and realize high inflation pressures would help a little in fuel mileage but certainly not the ride on our crap sections of highway. The weather was good so was not raining as that can really drag mileage down, in fact I had a bit of a tail wind on average driving home. Most people on here would never have driven on that freeway to visualize it but its got a fair bit of rolling type of landscape with numerous river valleys. For the most part I had it on cruise set to 62 although kicking it off if I caught it in time before it started down shifting and self braking going down the grades. Most of the more substantial grades its shifting into 7th I believe as 8th just doesn't have it. Total distance round trip was 643 miles and my overall average and I did refuel three times in all, figured out to 17.65 miles per US gallon. My best fuel mileage section refuel within all of this figured out to 18.46 and these are all hand calculated figures. I find if anything that the trucks computer can be over optimistic, sometimes its pretty close but other times its stretching it. On paper persay in theory the truck would have just about made it on fumes for that whole drive without refueling once.    Which made me think of the topic thread of the wonder if these trucks could do 20 mpg and that is a good question, certainly would have to be on an easy going flat highway, no head wind, the right temperature, not packing around a bunch of dead weight and puttering along even slower than I was I would suspect and going steady and not stopping to smell the flowers or take a piss !. It probably is possible but not without effort to attain that with the wind resistance and weight of these trucks. Of course on my drive most people are passing me if they have the power as per loaded highway tractors, never mind a lot of speedy vehicles but the speed limit is 68 and most are at or well over that.
