2005 Sierra, New To Me Friday Now Monday & $3,500 In Repairs?

Okay this is my first post here but thought some one could relate to this story or I might cheer somebody up tonight.

 

So, I find a nice 2005 Sierra 4x4 Crew Cab on Craigslist last week. The seller agrees to take the truck to a GMC Dealer so I can have a safety check done to see if this thing is legit. Dealer comes back with 3 items nothing major, Transfer case seal, RF Axle seal and blown speaker. Not a big deal...So I drive 3 hours and see it first hand and buy it.. Now I bring it home. Today dropped it off at my dealer to clear a check engine light and check the 3 items. My mechanic notices that the transfer case seal is NEW and the transmission vent tube is spewing out fluid on the case.. Does it get any better?

 

So, what should I do? I called the inspecting dealer and explained that in no way shape or form would I have bought this vehicle knowing that the transmission was shot. He informed me to take it to another GMC dealer for another inspection (2nd Opinion?) so I agreed and will take it Friday... My dealer changed the filter and fluid and told me the pan was full of metal and clutch material. It's shot... To make matters worse I really think the seller knew this which really pisses me off..

 

I maybe Irish but I have no luck at all

 

Any input would be appreciated..

Do you have anything in writing from the original dealer who did the inspection? Man that's tough. I'm certainly no lawyer, but I'd check with one. If you have to eat the price of a new tranny, look around you might beat $3500. Hope it all works out for you. Good luck and let us know what happens.

 

Too bad it isn't a Toyota, you could have a sudden acceleration event through the living room of the seller.

Try some lucas trans fix in the tranny first, I fixed a couple of my worn out ones that way.

Yes I have the inspection report from the dealer. Further the inspection request from ME reads " Perform Safety Inspection/ Customer is willing to buy this truck. Check over the Vehicle completly" (His spelling error not mine)

You'd have to be able to prove he knew about it. Only way to do that would be to find his dealer for VIN records and that assumes he went to the dealer for work.

So you posted today......what was the date you actually purchased the vehicle? Was if off a person or a dealership on craigslist? Most places that sell items these days on the web have a 30 day no question return policy if you are not satisfied. LOOK into now.....call a lawyer as well. The dealer definitely did not do his job inspecting the vehicle. Don't see what state you live in.....As for the dealer and your copy of the inspection report....does it actually say that they checked the tranny??? Having worked at one a few years ago.....a qualified mechanic knows how to check the tranny....if there is metal fillings they will find it within 5 minutes of getting it on the hoist.

I live in Michigan, truck was purchased from and individual in Ohio and inspected by a GMC dealer 3.6 miles from the seller. CarFax was clean but no dealer record of work. So, I assume he took it to an off line mechanic. As I said earlier, dealer was instructed to check the vehicle completly... I have all paperwork from that dealer however, it does not specifically call out what they inspected just what they found wrong.

Bummer dude. That seller and the dealership tech both need a swift kick in the jimmy.

The fact that my GM mechanic (who I really trust) said that 99% of all mechanics would have found this issue within 5 min.. That's the problem, I found the 1% guy...

A lawyer can't help !

 

The dealer did a visual inspection and a OPINION as to the condition of the

truck. So THEY are NOT liable as to hidden defects.

I am sure they have certain "limits of liability" on their service paperwork

that YOU signed so again your screwed!

 

Did the owner state he would warranty the vehicle or promise anything as

far as "new or replaced" IN WRITING" ?

iF no YOUR screwed!

 

Did the previous owner note "sold as is" on any of the sale documents?

If NO your screwed................

 

Sad but true and a major pitfall of a non-dealer sale which in most cases/

states would have some kind of limited warranty.

 

You could go whip the guys azz with a ball bat for some satisfaction !

Or maybe hes a stand up guy and will pay for a new tranny or at least

a part of it !

Yeah, update on what your lawyer says, but I don't see much happening there.

 

I would have gone to a private shop with a good rep and not a dealer. Also, it is buyer beware...you should have at least seen it before you drove there to buy it. He could have taken any vehicle to have inspected by any friend of his.

 

I don't know of any shop that drops a tranny pan on a quick "pre-buy" inspection. If it shifts right, they say, "Tranny....Check!"
