Family Files Lawsuit In Metal Baseball Bat Injury Case

WAYNE, N.J. — The family of a boy who suffered brain damage after he was struck by a line drive off an aluminum baseball bat sued the bat's maker and others on Monday, saying they should have known it was dangerous.

 

The family of Steven Domalewski, who was 12 when he was struck by the ball in 2006, filed the lawsuit in state Superior Court. It names Hillerich & Bradsby Co., maker of the 31-inch, 19-ounce Louisville Slugger TPX Platinum bat used when Steven was hit.

 

The lawsuit also names Little League Baseball and Sports Authority, which sold the bat. It claims the defendants knew, or should have known, that the bat was dangerous for children to use, according to the family's attorney, Ernest Fronzuto.

 

"People who have children in youth sports are excited about the lawsuit from a public policy standpoint because they hope it can make the sport safer," Fronzuto said after filing the suit Monday morning. "There are also those who are skeptical of the lawsuit and don't see the connection between Steven's injury and the aluminum bat."

 

Little League denies any wrongdoing, as does the bat manufacturer. Sports Authority has not responded to several telephone messages seeking comment.

That's todays America!! It's not the baseball bat manufacturers and the leagues fault their son is a ****, but thats who they want to pay. If they knew it was unsafe then why was their kid playing in it? It wasn't unsafe until little Steven was too un athletic or retarded to pay attention to what was going on in the game and got hit with a base ball bat. 10 years from now you won't be able to shit in a public restroom without signing a waiver.

There was a petition here in the city from this woman who wanted to ban street hockey. She said "someone could get hurt". The only idiot that's gonna get hurt playing street hockey is the one that can't understand the concept of "CAR!!!!"

You know they are gonna win the lawsuit and get a couple million for this right? I mean, if some idiot can spill coffee on themselves and sue, these people can too. Why work for your own money when you can take someone elses money?

this is sad and insane but im come to realize thru a few trips to nj that this is normal in nj and pa for stuff like this i mean heck we had people try to steal live power lines in pa then tryed to fight power company because it shocked them .

The McDonald's hot coffee lawsuit was a valid lawsuit, if you read up on it. McDonald's was purposefully selling coffee considerably hotter than anywhere else was, so that they could use a cheaper coffee bean. They had been warned that the coffee was hot enough to cause severe burns, but decided that the risk was worth the amount of money that they were saving. The woman received 3rd degree burns to her crotch that required skin grafts, and was originally only looking for McDonald's to pay her medical bills (Which they had paid for on several hundred previous similar cases). After they refused, she sued, and was awarded something like 2 days worth of coffee sales from McDonald's, and that was eventually appealed down to something even lower.

As for this lawsuit, unless theres something about it that the news isn't reporting, this is totally frivolous. It's too bad that the kids was hurt so bad, but playing sports usually has some danger to it. I'd bet that the parents even signed a waiver at some point acknowledging that.

I figure 30 mil easy, plus pain and suffering since I have had pain and weakness in my ankle since I was 12.

 

When are people going to realize there are associated risks involved with what we do. You chose to play baseball. If you didnt want to have a chance to get injured get a room, pad the walls and let the kid loose.

I've said it before, I'm waiting for some rich brat spoiled teen to wrap his Corvette graduation present around a telephone pole so his family could sure GM for making a car that could go 200mph when the speed limit is 70. Goodyear for making tires that could handle at the same speeds, the DOT for making highways so flat smooth and straight that he "could resist that temptation" and... well people like me for making fun a**holes and the BS lawsuits.

 

Opps guess I should have stopped while I was ahead!

    • Looking for help!   2019 GMC Sierra 1500 - 5.3l 4x4 8l90 61k miles - truck is in Arizona, was over 110 outside on Monday when this whole situation transpired. Never had any major issues with transmission until this point:   Truck sat outside my construction office for approx 1 hour idling before I realized, ran around the job site wrapping some things up for the day and then left. Went to get food and sat in the drive through for approx 30 minutes idling. As soon as I pull out of the drive through and onto the main road, rear tires lock up and feels like transmission fell out of the truck. Shifted to park, shut the truck off and tried again, same thing happened. Was able to reverse into parking lot (truck slammed into reverse). Let the truck sit turned off for 10 minutes before trying again, but it continued to happen. Towed truck back to my house. Highest the trans temps reached was 198.   Friday, after work I start looking into the situation. Truck sat in my driveway untouched all week. Truck is now driving like normal, transmission doesn’t get over 185 degrees when trying to heat it up. Got up to 60 multiples times with no issues, no issues accelerating, only down shifted hard into first one time at 185 degrees. Does anyone have any insight? Never through a code or a check engine light. Truck has never been used to tow either. No transmission services at this point.
    • Atlas won.   I know better, but I did it anyway. I took a compressed air line with a chuck and rubber tip and jammed it in the open EGR port. The port was clear as far as I could see, and as far as I could poke with a flexible wire, but that doesn't mean it's not clogged.   Compressed air blew back at me along with a cloud of black. Oops. I didn't have the rubber tip seated in there all the way. Jammed it up in there some more and squeezed the chuck. PSI was set to 120. Poof! It blew back at me again. Third time...pfffffttssssssspffffffsssfffffff, face full of carbon, and then, kind of a thud..and the air stopped spraying back at me. It was now exiting the exhaust with a low shhhhhh sound as it flowed through the pipe. Something broke free. I pressurized the port again, and air flowed.   Made my day.   Long story short on this problem, it's fixed. Something was really blocking the EGR passages down low, and compressed air blew it apart. I don't recommend this as who knows what debris was sent where. But it's allowed me to move forward, mentally, and onto the next problems I need to get this little S-Blazer going down the road properly again.  
    • Your truck lowered, looks good. I'm happy with the stance on this. I may need the extra ground clearance given my location/situation.
    • With this new pan, do you still use the same procedure to check the level? Its a deeper pan and our trucks do not have a fill tube/dipstick. So fill till fluid runs out the check plug?
