Dutch court convicts 2 of stealing virtual items

AMSTERDAM, Netherlands (AP) - A Dutch court has convicted two youths of theft for stealing virtual items in a computer game and sentenced them to community service.

 

Only a handful of such cases have been heard in the world, and they have reached varying conclusions about the legal status of "virtual goods."

 

The Leeuwarden District Court says the culprits, 15 and 14 years old, coerced a 13-year-old boy into transferring a "virtual amulet and a virtual mask" from the online adventure game RuneScape to their game accounts.

 

"These virtual goods are goods (under Dutch law), so this is theft," the court said Tuesday in a summary of its ruling.

 

Identities of the minors were not released. The 15-year-old was sentenced to 200 hours service, and the 14-year-old to 160 hours.

So, how exactly do you steal something that doesn't actually exist? Reminds me of a comment recently from an Identity Theft Victim: Sir, if I kill the person who stole my identity, would it be considered suicide?

I've heard of a few cases like this and situations where virtual items have been stolen. A few years back there were a few articles on this regarding the game 2nd Life where people would enter a virtual house and steal things. There are a few games where it takes real money to buy virtual game items. You can even look on eBay and find people selling virtual items for games.

 

Then conceptually your money in a bank is only virtual money till you have the cash in hand.

I think this is completely fair. Assuming it is virtual community service. Maybe they should have chopped off their virtual hands or throw them in a virtual pound-me-in-the-ass prison.

 

Prostitution and drugs are fine. But don't f**k with computer games. That's NOT cool. :thumbs:

Exactly right. Once theives have possession of these "so called" virtual items, they become actual items and are therefore prosecutable offenses.
