Ugh I Got A Speeding Ticket!

Well today i got my first ever speeding ticket. I was going 63 in a 45. I had just got done with 4 hours of class and was hella hungry so i was going to get me a billy barou at moe's. I noticed the cop as i was going down hill so i began to slow. I noticed in my rearview that she pulled and put her lights, so i pulled over yada yada and i got the ticeket.

 

My question is, my roommate said to ask for a trial by jury, and that the charges would be dropped rather than have to get a jury, b/c the ticket is for $81.00. Will this work?

 

My dad told me to go by the magistrates office to see if they will reduce it. He said to just tell them that im froma different county and unfamiliar with the roads

Can't really answer your question but around here if you go to court and fight the ticket and lose, which is more than likely what will happen, you have to pay the fine plus court costs. I doubt the 'jury' trick will work.

Trying to get it reduced might be a better idea. All they can say is No.

Trials are not run like a business. They don't care about profit/loss or return on investment.

 

I use the old standards... were you actually doing what they charged you with? If yes, then accept responsibility for your actions.

Yea i was going 63, and i accept full responsibility, but if there is a way to get the fine reduced or thrown out, then i don't see anything wrong with that

How would you get it thrown out? Claim the officers speed gun was whacky? Right now, most cities/counties want every penny they can get out of you. If you ask for jury trial, it'll be put on the docket to be held when they have other cases for a jury. I've served several times on Municipal court juries. Don't know where you are, but you might be able to take Defensive Drivers course and keep it off your record. You'll pay court costs and the cost of the class. But no ticket on record and a possible 10% discount on insurance if offered in your state and insurance company.

In the past, I sent in the ticket pleading "Not Guilty"....State Trooper met me in the court room and said he would reduce the speed from 70 mph to 60 in a 55 zone....knocked down the fine a bit. If you then actually have to face the court, state you were unfamiliar with the area and did not notice the change in speed limit. Now, I'm not saying it'll work...just my past experience.

Just ask if they can reduce the fine and pay it whether they do or don't. You admitted you were speeding. Don't lie, just be honest and take responsibility.

Dude its $81 haha. my tint tickets are $115 and my last speeding ticket was $145. You were speeding and just pay it man. Its low.

Only $81?!?! Just pay that... My ticket for a 73 in a 65 was $185... Just pay the $81 and be done...

I got 3 speeding tickets, 3 tint tickets and one seat belt ticket and mines never been raised infact it just went down this year

You can have what they call a "bench trial" where there is no jury, but only a judge. OR you can request a jury trial if you wish. EITHER WAY if you are found guilty you will have to pay for court fees which can be UP TO $500 or more.

 

Plus there is the whole concept of having to present your case. If you get a lawyer your looking at big bucks. I would suggest paying the ticket unless you know FOR SURE you have a good case. Otherwise you will be wasting time and possibly a shit-ton of $$$$.

 

Edit: Also, I highly doubt you will get a decrease for "not knowing the speed limit".

im in south carolina, and im going to go talk to the magistrate to see if they cant lower the fine or make it so their wont be points taken of my license
