Request the deminished value check and don't take it to a body shop that any insurance company partners with. This will help keep your repair done by an impartial repair shop.

like others are saying, demand new genuine OEM replacement parts and have the repairs made at the body-shop of your choosing. in the event that the person at fault's insurance company is contesting the use of new OEM parts then notify your insurance company and leverage your own coverage via subrogation. your agent should be able to help you as you were not at fault.

Ask for "Diminished Value" and explain why you feel deserving of it, but don't expect the insurance company to just give it to you because they rarely do.

I'm going to make sure to explain my case to the insurance adjuster as best as I can and explain that with my truck being so new they use oem. My truck build date was April 29, 2013, and I bought it may 29, 2014. My truck was in mint condition till the accident. I'm gonna fight tooth and nail for every penny i can get. I will post an update tomorrow after the insurance adjuster goes over everything

Not sure how New York works, but I had a diminished value claim about 13 years ago in North Carolina. With anything associated with insurance there are plenty of "helpful" websites/attorneys willing to help you FOR A PRICE. I found out that some of the best info I could get free of charge was from our state's Department of Insurance (not sure if NY has one but I think the dept of financial services does this there) in Raleigh. I called their toll free number and they informed me of the process and how/what I needed to do. At that time and to the best of my recollection I had 30 days after repairs were completed to file a claim of diminished value with the insurance company of the at fault driver. I did so and they agreed to around 20% of the damage value as a payment for diminished value; they didn't even protest. I agreed and didn't push it as the vehicle I was driving was actually a lease. I actually came out smelling like a rose, but it was still quite a bit of work. The insurance company was actually really good to work with, I chose my own bodyshop and they did an awesome job. That was a long time ago and things are probably different between states and with the passage of time. But I hope you have as positive an outcome as I did. My suggestion would be to start with New York's department of financial services.

From everything I've been reading, and by talking to some of my friends that's actually work for an insurance company in auto claims, said that NY is one of the hardest states to get anything for diminished value. A lot of posts are saying that I would have to even attempt to take the other "party" to claims court to get anywhere with the insurance company.

Thanks for all the replies, so far I'm scheduled to have the insurance adjuster take a look at it Monday. But I'm thinking about taking it to a shop that does free estimates, before then to just have an idea and some numbers to fight the insurance company if they try to low ball me.

If they do not cooperate by compensating for ALL OF your losses as a result of THEIR insured's negligence, find a lawyer and file a lawsuit.

 

Insurance adjisters are not your best friend, not even the ones from your own insurance company.

From the look of the impact, you may even want to have your neck checked out by someone. Some injuries take a week or two to reveal themselves.

I work for a body shop with about 5 locations and a tire shop. We ALWAYS use new oem parts on new vehicles. We always try to get new oem every time and if we cannot we have to go used but everything is inspected. We have a lifetime warranty for ALL work done. I got a shit door put on my sub about 2 yrs ago bc the adjuster said 1,800$ now i have to use my lifetime warranty to get that fixed because the used door is rusting. They will replace the door whenever i bring it in

So just got back from going to the All state insurance adjuster. They quoted the repairs for damage in the amount of $3,072.70. with an estimate repair time frame of 8 days. I've been in contact with my dealership, and the truck will be starting repairs this coming wednesday. Everything is going to be repaired with OEM parts. I asked the insurance adjuster about filing a diminished value claim, and she had no idea what i was talking about, Explained it to her, and she replied with "accident loss is only a dealer gimmick". I told her not to me it isn't, I paid 40k for my vehicle, and besides normal depreciation, this accident is going to cost me more equity on a trade. She then proceeded to indicate that I would have to prove it, and that i would have to contact the main office to get a Diminished value packet. I think its funny that she acted like she didn't know what it was, and then went to telling me how to get the process started. I called the main office, and an "agent" explained that she is not licensed to work with Diminished values, but will make a note on my claim to have someone who is licensed to call me. Let the FUN BEGIN!

An insurance adjusters PRIMARY PURPOSE IN LIFE is to save the insurance company money, not spend it.

I got clipped in the rear in my 2003 SS and the initial offered 600$ to repaint a plastic cladding piece. The real damage was benind the piece, which included painting one side of bed and realigning the tailgate gaps. They ended up paying 2850, and also paid for a rental car while my vehicle was in the shop.

 

You will undoubitadly have a lower resale value with damage history versus no damage history.

Since it was at no fault of yours, you should be compensated.

I'm making sure I keep a record of every phone call/email and conversation I have with Allstate, just so I can have some sort of record . Just in case they try to screw me over. I made it clear to the dealership I want my truck to be back to oem specs.

See if a dealership will provide you with a document that describes how your trade-in or resale value is diminished due to the wreck being in the vehicles history.

Well the truck is at the dealership to get repaired. Manager of Collision shop told me, that they were basically just going to throw out the allstate estimate and start from scratch to verify everything that is needed. (Said he could do this, because they are an Allstate Good hands, collision shop) Explained that I want all OEM parts. Manager told me i would probably hear from him tomorrow with their estimate and time to completion. All state originally quoted 8 days so I'm going to be counting the days till it's fixed. Also an update on Diminished value, they are still giving me the run around on Diminished value, explaining that it takes a few days for a rep to be assigned to my claim.

    • This is a 1/2 ton thing ONLY.  All HDs 2020-2026 have the two speed transfer case, with Autotrac as an option.     1/2 tons 2019-2026, regular 4x4s come with a single speed case (no 4LO!), and trucks with Z71 ordered, or all Trail Boss trucks come with the 2 speed case.  2 speed case is also an option on WT, and is also standard on High Country.  
    • 2013 5.3 still to this day calls for the PF48 filter.  Which as a 15psi bypass pressure.     There is a TSB, 17-NA-157 that talks about the PF-63 and PF-64 filters which have a higher bypass rating of 22psi.    TSB HERE - temp.xml   "Beginning in 2012, the oil pumps began to regulate main gallery feedback instead of pump out pressure. This means that the oil pump now does not begin to regulate until pressure is built up to the main gallery. This change reduces the amount of time it takes to provide oil to the engine bearing and lifters during extreme cold start conditions.  Main gallery feedback oil pump control systems are present on the following engine families which use Spin-on oil filters: Small Gas Engine (SGE), Large Gas Engine (LGE), High Feature (HFV6) Gen2 and Small Block Gen5 gasoline engines. These engines with the main gallery feedback oil pump control systems are factory built with an ACDelco® oil filters"   It also calls out what engines use those filters.  The gen 4 small blocks were not on that list (LMG, LC9, L9H, L92, L94, L20, L96).  Gen 5 small blocks use the higher pressure filter.          That all said...   Your 7045 Napa filter is the PF63 equivalent, with 22psi bypass.  You are already using the higher bypass pressure filter.  You CAN keep using it, you don't technically have to use it though.  
    • Do you know WHY the filter relief setting was increased to 22 psig?    When the new system goes into the second stage the pump volume ramps up considerably. It was found that the 15 psi filter bypass setting put the filter in bypass on a warm engine when the second stage was activated. Raising the filter bypass setting forced the filter to do what it designed to do. Filter. Preventing debris from circulating during high load, high rpm operation.    So next question is how did GM find this out? VLOM/lifter failures and a deep dive by Melling Corp.    Last question. Is it required? Look at it like this; a motor may be equipped with a rev limiter. But it only works if the set point in reached. That 22 psig setting only matters if the pressure differential across the filter media exceeds 15 psig during normal warm operation. Second stage kicks in around 3000-3500 rpm.    I can't answer your question because I don't know you and how you use the truck. But I think there is enough information here to let you decide for yourself. 😉
    • Probably not their first rodeo, so it should go as planned most likely.  Typically the service manager or tech doing the swap will put some seat time to shake it down after they get it all put back together.  We usually put 50-100mi before we hand them back so if something happens, its not after you get it.  A coolant leaks, oil leaks, a ground left off or loose, vibration, etc.     The new engines so far have been good?  There's been a couple that have popped out there again (the replacement engine) but most have been okay.
