rolled my 04 burb today 4 times

Thank God Im alive guys. Somebody lost control of there car , crossed the divider , hit me on my driver door and rolled me 4 times.Jaws of life had to cut me out. Im alive today with minor injuries. Had two signed whittnesses who saw it all and made reports, again thank God. Now I hope Ill get a new one out of the deal, only had her for a year. QUESTION ? whats the 05's like ? any changes or things to look for or should I look for an 04 left over?

The Guy was flying, he was driving a Merc Sable. He pushed me sideways off the road. Thats where I believe I rolled when my tires hit the dirt. Had an MRI and x-rays all looks good. Walked out the Hospital the same day. MUCH pain in neck and back and a slice on cheak under eye. cant sleep tonight (kind of upset) . Whats the next step ? Should that Guys insurance pay for new car or am I out 40,000? Never had this happen, do I get a lawer? As long as im ok , im really not a sue happy person, just want to be paid for rental car fee's , a new burb and so on.

just want what I lost.

Oh man...I'm glad you're okay. Be ready to be sore for a week, and be scared to death of driving for a month or two.

 

Not sure about the lawyer thing, I've never sued anyone, so I really can't help you there.

 

But the rental thing...As long as he had insurance, and they pay out the claim. You should get a rental car, but it will be something like a two-door speck. A Focus, or something along those lines will be what you're driving.

 

There are also limits to what they'll pay out. If he has to replace a $40,000 Suburban, that will eat up most of it. Most people have the minimum for your state (you probably do as well). Here it's something like $50,000 property damage. Anything above that, and you'll have to go after him personally...Or, if the claim goes above that, your insurance company will go after him.

 

At least that's how I understand it. My girlfriend works in the claims dept. for Farmers so I get an earful about insurance crap....I quit listening after about 30 seconds each time though, so I'm no expert. :D

 

Once again, it's good to hear that you made it not much the worse for wear. :eek:

Hopefully it will be settled quickly.

My brother had his hand broken and my dad's 1-ton and 30 ft. trailer totalled when a guy pulled out in front of him in a commercial truck. 1 year later and the insurance company still hasn't paid anything on his medical bills. Good luck.

Im really so touched by the guys on this site. Its like a real family. Over the years Ive learned so much about my trucks and felt good knowing that I could throw out a question and so many would really care to give honest advice and save us all money. My wife cant believe how addicted I am to this site. I must check it out at least twice a day to see how your all doing and what I can learn. Its really cool I must say, how you all really care about each others trucks , and In this case even me. THANKS GUYS. yeh I to sound un man like but I am a little scared about getting back in the seat. Oh well. And yes the other guy seems ok and was taking to the Hospital for observation. He said he just lost control (I really dont know) Hey the cool thing that really touched me,is that the Cop (that sometimes we dont like) stopped by the Hospital to see me. And to all you emergency response guys and s, YOU guys are great. Had 15 people around me inabout 5 min. cutting me out. Hey enough of this musshy stuff. (just kind of feeling weepy right now) hey its 4:00am and still cant sleep..

Glad to hear you are safe and good luck getting a replacement burb. To my knowledge the 05 got a new lower airdam, and changed DIC features. Thats all that comes to mind...

Sounds like an awful accident, but the best part is that you are able to be sitting here right now explaining the ordeal.

 

If you have full coverage on the 'Burb, then the claim will be much easier because your insurance will stand behind you and bail you out if need be...

 

Just remember you don't have to "settle" with the offer from the insurance company. They are like car dealers and don't want to to give you any more than they have to... Everything is negotiable, and you can request more money, if you're not happy with them. You should be elegible for taxes/registration also. Basically they should give you enough $$$ to put you back into an identical '04 Burb and it shouldn't cost you anything. Just remember that it isn't always easy when dealing with Insurance Companies.

I've hating being behind the wheel for quite some time after every bad accident I've ever been in.

First and foremost, I'm glad you came through this like you did. Sorry to hear about your Suburban. But, thankfully you were in it as opposed to an econobox. I know gas is expensive for these vehicles, but you are living proof as to the advantages of a large vehicle in a crash. About 5 years ago, my father-in-law was in a vehicle hit headon by a drunk maniac who was trying intentionally to kill himself and his family. Thankfully he was riding in a Ford F-350 doublecab duel wheel truck. The investigating officer said had it been anything smaller he had no doubt that all five inside would have died. As it stood my father in law walked away with a broken wrist. As hard as it may be, don't sweat the truck, GM makes them every day. Here's to a better Thurday!!!

GLAD TO HEAR THAT YOU'RE OK! You're gonna be sore for a while :eek:

 

Just a thought but you may want to consult with an Attorney before you sign ANY disclaimers from the OTHER GUY's insurance co..I'm not suggesting you sue, just protect your rights. I just don't wanna see you get rolled again (sorry, I had to throw that pun in :D )

Man thats terrible 'bout the new 'burb but like everyone else I'm glad your alright, and like vroten said GM builds them everyday.

I agree on the seat belts,they've saved my life a couple of times,I won't move one foot without wearing one. :D

And I also think it would be a good idea to talk to an attorney before you sign anything,just to be on the safe side and to cover your butt.

Again, glad to hear your OK. My wife had an accident a year or so ago, nothing to serious. The woman that hit her tried to fight being at fault. Our insurance company asked if we wanted them to fight it or would we be hiring an attorney. Seems that what you pay insurance premiums for, DUH. Let your insurance go after the other driver. They should rent you a comparable vehicle to what you were driving and fight to either get your vehicle repaired or replaced. Anyway , Good Luck and recover fast. BTW we're all glad you werent driving a compact car, would have been alot worse.
