What Would You Do?

You're selling your vehicle, someone comes over and test drives it and looks over it, decided they want to purchase it, gives you a deposit of $100. So you hold the vehicle for them, for close to two weeks. In the mean time, other people respond to your advertisement, one even offers to purchase vehicle right away cause they need it, but you tell them someone has already placed a deposit on it. So finally a 1 1/2 weeks past, the guy who places deposit calls, and a couple days later returns, then asked questions about vehicle. Then for some reason decides not to purchase vehicle. So now you have to relist advertisment over again, hoping you can get another buyer. Then after 2 weeks of person who puts deposit down, emails you back asking if he can use deposit money for another item you are selling "basically asking back for deposit".

 

I was like no way. You place a deposit on a vehicle, you are asking me to hold the vehicle and not sell it to anyone else.

At $100 deposit, I would've told him you would hold it for one day. I think I would've sold it to the guy who had all the cash, and just gave the other guy his money back.

A week or two is WAY too long for only a 100 deposit. A day or two is ok... but not a week or two.

 

I also would have sold it to the guy with the money and gave the other guy his deposit back.

Depending on the time of day $100 would've bought him till the end of the business day or 24 hrs in my book to get his financing together, judgement call. After that I have $100 in pocket and I'm on to the next buyer. I always have a time limit on "holding" something for someone with a deposit and I state it up front.

 

You're $100 better off. If the same guy comes back again, tell him $200 deposit gets him till the end of the day.

I agree, the deposit covered you holding the vehicle you had for sale. You did not mention what agreement you had withthe interested party. Next time you need to explain the terms to the purchaser, example "this deposit will only hold the vehicle for a certain time frame etc".., both parties need to agree and signatures always go a long way. As I do not know the details as what was discussed, I will go with the deposit was for the holding of the vechicle and it is your decesion weather you will honor it on any other item or not.

i would have only held it a few days, and kept all the numbers of the folks calling for interest. so i could sell to them if their still interested if the guy didn`t take. then just give him the $$$ back whenever he did show up. I remember having a few guys look at my snowmobile when it was for sale, one guy "said" he`d take it for 200 off my asking price when he returns with a buddy to inspect it, i thought okay i could settle with it, then 2 days pass and another guy shows up with a cheque, and wanted it NOW, what to do? i cashed the cheque the next day and he picked it up, the other fellow was alittle cheesed, i basically told him "I don`t give a shit!" When your selling stuff you want it gone....simple, NO RULES!

In my opinion he would have forfeited the $100 by not showing up with the rest of the money.

When I sell a car I refuse to take any deposits. I tell everybody that the first heartbeat that shows with the cash is the new owner.

 

You'd be surprised how fast my Jeep sold.

Well he just emailed me again asking me to send his deposit back, and explained to him for the last time that I told him when he wrote me the check that it was non refundable and that I will hold the truck for him, which I did for almost 2 weeks. I then blocked him from emailing me any further. I don't understand how he thinks he can place a deposit and then after 2 weeks decide he doesn't want to buy the truck. In the mean time, I could've gotten my asking price from a guy who needed a plow truck asap, I kept up my part of the bargain and now this guy emails me weeks later asking for his deposit of $100 back?

 

He is a person who wants to get into the landscaping and snow plowing business and I also spent a good 1 1/2 hours teaching him tricks of the trades and how to price out driveways and lawns, and services to include in estimates. I did not charge him a dime for that. I bent over more then backwards for this person, and he is being nothing but a troublesome pest at this point in time.

 

So if this should esculate and he wants to take me to court, any ideas for a counter suit? I can think of none, except I could've got my asking price from a contractor who wanted the truck right away. But that sounds like all hear say to me.

If this were me, I'd just ignore him from here on out. Seriously, what does he think a deposit is?

 

I kinda doubt he'd take you to court for $100. If he does, he's just crazy and you'd be better off just giving him his $100. It doesn't sound like he'll make a very good businessman, especially in the 'service' industry.
