Rock Damage

Ok, so I just went to lunch this afternoon and got on the interstate next a dump truck. It was carrying a load of gravel and it was NOT tarped. It was dropping gravel out of the bottom of the box onto the interstate running about 65 mph and throwing it everywhere. I tried to get out of the way but with traffic it wasn't going to happen. A pretty good sized piece of rock came out, and in what seemed like slow motion, it hit my windshield. It took a pretty good little chunk out of the glass and I still don't know how it didn't crack it. Also, it chipped the paint pretty good on my grill (colormatched GM accessories grill). For those of you that have had this happen, have you called the truck line to make them pay for the damages? I don't want to stare at a chunk of missing glass and my grill is pretty messed up (as you all know the GM accessories grills are not cheap). I'm sure they will come back and try to deny that it wasn't the truck and it was already there and they won't pay for it. How have you guys gone about it and have you had any success?

I'd call them up for sure, I would have had to follow that guy and have a little chat

I'd call the trucking company and your insurance... report it

Slow down and stay far enough back! That's what I do when I can't get over. I'm not going to let that crap hit my truck and take chips out of it, because of being stupid! I know he should have had it covered, but you knew and saw it was falling out and let it beat the paint/glass up! It's just as much your fault as it is his....

Around here the dump trucks have signs not responsible for damage. What a crock of poop. You cant put a sign up and then let stuff fly out of your bed and not be responsible.

They have the signs around here too, but I think think it's BS as well. All trucks are supposed to be tarped here. When I got on the interstate I was about 30 yards behind it and slowing catching to maintain speed with the rest of the traffic. I couldn't see anything in the box and about the time I was passing it he hit an expansion joint in the bridge and that's when stuff started flying. I had no way of knowing anything was in there or would come out. It's not like I was tailing the guy, I was on the interstate for maybe 2 miles and didn't have much of a place to go and couldn't slow down that much with all the traffic. I would have created more of a problem by slowing down that much to avoid the rocks.

There on all bid dump trucks here too... usually say "CAUTION- DO NOT FOLLOW'

 

Unfortunately , it will prob get you nowhere going after trucking company.... They will come back at you with prove it was us....

 

The glass, can prob be fixed by a chip company, for free thru your insurance... and if not fixed , replaced for free thru insurance pending u have full glass..

As for the grill... you can prob get some touchup paint and fix it.... grab some pics of it..

During the heavy construction period here in Florida in 2004-2006, there were literally hundreds of fully loaded dump trucks all over the roads. Even though they were using load tarps to cover the cargo, it did little good as most of these trucks would move at speeds 70 to 80 MPH - yes that fast and I do not know what kind of engines they have in them to go so fast with a full load. The tarps would not prevent clouds of sand behind every one of these trucks (Florida dirt is mostly sand), so if you followed one of these, you would get your windshield sandblasted in no time.

 

Personally, I stay as far away from these trucks as I can, and if I have to pass them, I pass them quickly.

I agree. You can go after the trucking company but don't expect much success. Chalk it up to a lesson learned.

I would say and I am no lawyer, I haven't slept in a Holiday Inn in some time either.

 

If they are following the law and cover with a tarp That's the law in my state as well. Then the disclaimers may be a defense for them, but... if they are violating the state law by not using a cover they may not be protected and be liable.

 

You should have took pictures, phone camera, of the truck with no cover. hard to prove now.

 

Or consult your local ambulance chaser.

Yea, if I could have snapped a quick picture with my phone I would have but I didn't really have time. But, the good news is that once I got home and really looked at the windshield I noticed that it was actually just pieces of the rock that was stuck to the glass. I was able to wash it and use a razorblade and it all came off and you can't even tell. So that's the good news. I'm going to try to use the touch-up paint and see how that goes. After thinking about it last night I figured I didn't have a shot at it and with the glass being ok now, it's not bothering AS bad. Rock chips still hurt even though you are bound to get them no matter what.
