Transmission problems

I've started having some issuses with my transmission shifting from second gear to third. I dropped the pan and pulled the filter, there wasn't much if any gunk in the fluid and the filter appeared to be clear but the fluid (which has at least 50k on it) is dark and appears burnt. I can see no other problems. Everything that should move does and all wires are in place. Suggestions? Should I replace the filter anyway and top off the fluid, or would that be just wasting money?

What is the specific issue with the 2-3 shift? If you already dropped your pan, it would be penny wise pound foolish to not replace it. The filter set at Advance Auto is like $17 after using a 30% off coupon online and picking up in store.

Thanks. I kept getting an error message that the message would not load. The problem in shifting is that it takes longer than it should to change gears. I have to back off the accelerator and then push back down or it just keeps adding RPMs without shifting. I certainly wouldn't put it back together without a new filter and fluid, but I may have a problem that requires more repairs and with no drain plug the 5 quarts I put in if more repairs are needed would just be wasted.
