My parents sold their car miles to a couple in a neighboring town a few miles away. They came down on the price took a personal check from the people, because they had given my parents a veteran sob story(They know better, or at least do now). Probably a lie, cause the check bounced, they went and got the car back, they people handed the keys back. The people then called the cops, reported it stolen, and since my parents had signed the title over a few days before, and it was notorized, the police made them give it back to the theives. In fact the cop said it's perfectly legal to bounce checks all day long, and couldn't understand why my parents were angry over not getting paid when they were supposed to(yes, I'm serious) My parents are going to taken them court if they have to, and I am currently going through the public records now online to get any criminal background. any other ideas?

 

Update: court records show she was taken in by her bank for over 3800 in unpaid debt, and he was taken to court by her over child support just a few months ago....interesting. And the bank called and said that they can cash the check at 4 PM today....we'll see.

 

Moral of the story: don't take personal checks on cars! Its too easy to get a cashier's check

Man thats why when a car is going to sell for less than $5000 and its a private party sale that the buyer needs to have cash... Adn you never complete a deal until the check clears...

 

I think that you are doing all you can do.. Make sure they have all the records of the bad check and the bounced check information... Also see about filing a Mechanics lein against their house for the money that they owe your parents they will never be able to sell their house until they pay off the debt...

That really sucks. I'm sorry that your parents had to learn that lesson the hard way. Yes, once the car is signed over to the new owners it doesn't matter if the payment method is good or not, the car is theirs. Taking those dishonest people to court to recover costs is about the only route your parents have. Also, your parents should include court fees in the money they want. The lien idea is good too, but also will cost money.

 

The rules for private party sales payment. Bank draft, bank certified cheque, money order, cash, and for a personal cheque, no transfer until the cheque clears.

 

Good luck to your parents in getting their money back.

Accepting a personal check is one thing...but signing over the title prior to it clearing? No offense to your parents, but that is just plain stupid. Most credible buyers would not even ask to use a personal check, they would get a Cashier's check.

Always write a contract for the purchase, detailing the agreed upon transaction (vehicle with VIN for amount and payment type) and have both partys sign. Not something you need a lawyer for, just write it straight forward and it will help in cases like this (violation of a contract).

I was going to suggest filing a report for passing bad checks. I know we get calls about them often enough at our place. We basically tell parties to send them a certified letter demanding payment in x days or the matter will be turned over to the police. If there is no action, we have them come to our place with a copy of the letter and a report gets done, etc.

I'm glad the check finally cleared. I've excepted personal checks before to do home improvements on peoples houses. I make them give me 1/2 down before I ever start the job, or bring any material that I will need. I've been lucky, and never had one bounce. I write up a contract, and give them 72 hrs. to change their mind before I do anything. I damn near got sued for not doing that once. I went to the sight, and tore off all the old siding, and the home owner came out and told me he had changed his mind. He wanted his house done for free, the old bastard. :lol:

It's F$%KING people like this that make it hard to trust anyone or want to help anyone. I don't know what is wrong with people today. What a bunch of LAMEA$$ SOB's! :lol:
