Story link --> GM says bankruptcy excuses it from Impala repairs

General Motors Co (GM.N) is seeking to dismiss a lawsuit over a suspension problem on more than 400,000 Chevrolet Impalas from the 2007 and 2008 model years, saying it should not be responsible for repairs because the flaw predated its bankruptcy. The lawsuit, filed on June 29 by Donna Trusky of Blakely, Pennsylvania, contended that her Impala suffered from faulty rear spindle rods, causing her rear tires to wear out after just 6,000 miles.

"New GM's warranty obligations for vehicles sold by Old GM are limited to the express terms and conditions in the Old GM written warranties on a going-forward basis," wrote Benjamin Jeffers, a lawyer for GM. "New GM did not assume responsibility for Old GM's design choices, conduct, or alleged breaches of liability under the warranty."

With that kind of customer service response from GM, I'd like to see them go under permanently.

That would be great for all the people they employ and the rest of us that like GM products...

I wonder what kind of shape the country would be in if they never allowed so many foreign competitors to sell here.

You mean controlled markets? Ask all the countries that have tried communism how that worked/is working out...

Free markets drive competition. If they kept the markets closed the big three wouldn't bother to innovate and compete as much as they do.

hypocrite much?

What about all the people that the foreign "competitors" employ in the US or the "rest of us that like Honda/Toyota/etc products"? I guess we shouldn't let foreign companies sell in the US because you don't like their products.... Sure that would work out great...

I'd let ANY company go bankrupt if people stop buying their products because of bad customer service, bad products, etc. Don't care where they're based or how many people they employ... someone will be there to pick up the slack and make other products in those factories.

 Nuts I tell ya.. just nuts. I wouldn't be happy with that kind of legal garbage. The people bought those cars with the good faith that GM would stand behind them when/if issues came up. I would think the impact of that kind of customer service is going to cost GM alot of customers.

The suspension "problem" is a wheel alignment issue that causes abnormal tire wear. Go buy a Toyota, have a wheel alignment issue and see what they tell you to do with your worn out tires. I remember Matrix, Corolla and Sienna owners (just to name a few) that were hella pissed about there abnormally worn rear tires and Toyota told them to go fly a kite. I know, I was working as a front end tech in a dealership that sold Toyota as well, at the time.

It's a crappy situation. GM has every legal right to not take action to the best of my knowledge, though I would like to see them do so as an act of good faith.

I've seen plenty of them covered under warranty and I'm sure most dealers will continue to take care of their customers appropriately there just isn't going to be a mass freebee repair done, that's all.

For what it is worth - I had some issues with a GM vehicle that I originally opted not to fix due to price. My GM rep called me back on his own accord and said GM would cover over half of my bill for the repair because they thought the maintenance was prematurely needed. I was shocked by this - I had written the company off but this kind of customer service made me change my mind.

First off, what the hell are "faulty rear spindle rods"? Secondly, when GM went "bankrupt" why wasn't my loan with GMAC written off? If they can refuse warranty due to this, can I refuse to make my payments to the now defunct company as well? Would seem fair to me.

LOL......Because you were not deemed "to big to fail" so you must suffer like the rest of us and pay your bills. Nothing like crapping on the little guy.

Wow, and then GM wonders why they find themselves in a mess and need to file bankruptcy. I just don't think they will ever get it...
