Carfax says my brand new truck is used.

I bought my new Silverado on 3/08/14 and bought an extended warranty. When I registered it at Chevy's owner site I noticed all my warranties showed the in service and start date of all warranties on 11/22/13. I paid for a Carfax and it says the truck was sold on 10/25/13 and then again to me on 03/08/14.

When I first told my dealer that information I didn't tell him where I found it. He said I was wrong and whoever told me that was also wrong. He then hung up on me. I called him back and I told him I got the information from Chevy's web site about the warranties and that Carfax showed the truck was previously sold. He said They had registered the truck with warranty division. He told me he wasn't going to spend $40.00 on a Carfax and that I could bring my copy out to him if I wanted him to see it. I went out to the dealer Friday and showed him the Carfax and he wasted no time telling me that Carfax is wrong and that it is up to me to get the previous dealer to straighten out the mess with Carfax. I told him I paid for a new truck and I wanted a new truck and he said that aint gonna happen.

Here is the questions I need answered.

Knowing that Carfax showed it sold on 10/25/13 and he says Carfax is wrong, who in their right mind would take the dealers word over Carfax?

I am ending up with a 31 month bumper to bumper warranty, in what world does a new truck purchase only get a 31 month warranty?

Should I wait to see what GM Detriot has to say or shoul I just see an attorney?

I would like to contact the GM rep on this site but the last time I contacted them they didn't even read what I told them and instead told me to take my concerns up with my dealer.

What bothers me more than anything is I have bought 7 ne vehicles from this dealer since 2007 and this is how I'm treated for my loyalty.

You may want to speak to a lawyer also. This isnt gm's fault but it is the dealer who needs to correct it.

Absolutely no reason for warranty to have already started. You were sold a used vehicle. If they claimed it as new, sue the snot out of them.

Sales contract says new, also says 36 months and 36000 miles bumper to bumper warranty.

That chances things. A lot. A demo would never be registered so it can still be considered new legally but the warranty started when it was used as a demo. You're out of luck.

Even though the Carfax shows it as sold before I bought it, it can still be considered new?

No idea on the carfax but for a vehicle to be considered used, it has to have been registered. A demo would not have been registered. If you can prove it was registered then you have ground to stand on though.

I guess I would have to get with the finance company to see if it were previously registered. I was show as sold by the dealer that my dealer got it from in Iowa.

If I buy a truck with 3407 mls on it I'd always consider the truck used.

Even when the dealer tries to sell it to me as new.

 

I bet that you had a good deal on it.

 

When the law is on your side, congrats.

But next time you should pay for "new" to get "new".
