Makes me want to think that if he was the one that caused an accident that he would try to go after them for something because after all it's their fault for being in his way.
The world really could do with more level-headed people.

She was more than likely tailgating. I hate tailgaters. I don't tailgate ever. I don't want the rock chips for one thing.

Whenever I'm on the highway and come up on slower or stopped traffic I tap my brakes several times to get the attention of the idiots behind me. If it's a sudden slow down I really get into it tapping the brakes as fast as I can while slowing down. The quick flashing brake lights get the morons attention effectively.

Try it sometime.

It works.

BTW I live 1/2 mile from I-94 and I avoid it as much as I can. There are several 2 lane blacktop roads I'd rather take. No traffic.

Maybe she was, but do you think you should ruin her life over it? OP got out of it if only a little sore. Some of these responses here are basically asking for the blood of her firstborn. Accidents do happen.

Dang, this got heated quick... lol

 

Believe me, I was fuming, and may have been more rude to her than I should have.  And my reasons were geared more toward 'now my truck is damaged and not the same' as opposed to 'we could have died, or someone else could have been seriously injured.' Was I wrong, maybe/maybe not, but I bet my life savings she will pay more attention and not be on her phone while driving anymore.

 

I thought about every avenue to sue her and her parents, but after a couple days I cooled down.  Trust me, I want her to pay, but bankrupting someone/family on an accident seems aggressive.  Shit happens.  Ill be milking it for as much as I legally can.  Even thought about how I could have a 2020 fully paid for...

 

She was at least 2 or 3 car length behind me, so she wasn't tail gating - and that's why I figure she was on her phone.  She told the cops she hydroplaned (false).  I would like to figure out how to get phone records.

At first, Allstate said they dont do DV claims but after persisting, they finally started the DV claim. It is a separate process from the actual repair claim. They tried lowballing me first but I wouldnt take their offer. I finally got close to the amount I wanted.

 

And just to add, a DV claim doesnt necessarily mean you are planning on selling or trading in your vehicle. It is compensation for what your vehicle is worth just prior to the damage and the loss of value just after the damage. As most will be aware, when folks are shopping for a used vehicle, they will many times request a carfax report or Autocheck report. A damage free vehicle will command a better price than a vehicle that has been previously damaged and especially when the reports show frame damage. Many will not even consider a frame damaged vehicle even if it is completely repaired back to factory specs...

I've already argued and argued, right now ball is in my court until they tell me DM is less than I want.  I have about three dealerships already quoting me a before and after price.  We'll see what happens.  Once I sell, ill really have to price it well so that someone would consider it (probably still get lowballed)

I hope everything else other than the bumper is okay.  Ive open and closed all the doors and all good.  the bed didn't look like it moved either.  But Im guessing you were referring to her car since you quoted the jeep pic.  I would be curious to see/hear the total damage on the Jeep tho.

That's what's wrong with the younger crowd these days especially women. They haven't a clue. To big of a hurry.

If someone is 2 or 3 car lengths behind me even at 70, I move over. I don't want you on my ass period.

Look in your mirror next time someone comes up on you. Bet they are under 25.

Getting mad at an accident does no good for anyone. Making sure everyone is safe is your first priority and keeping calm and rational at the scene are critical to keeping it safe.  Save the blame game for the police, your insurance companies and, if necessary, your lawyer.   Few people choose to hit another vehicle yet it happens many times a day.  Poor driving behavior by at least one of the vehicles involved is usually the cause and all of us have exercised a lapse in good judgement at one time or another.  Being accident free for a long period of time has a certain amount of luck involved, imo.  Most of us have experienced a sphincter tightening moment or two when we knew luck was on our side.

2-3 car lengths is amble space to slow down at 80 mph, unless you're not paying attention.  Im always paying attention to my surroundings (from riding motorcycles), but only so much I can do.

 

I don't want to bankrupt her, it was a comment from another poster.

I agree.  I did make sure everyone was okay, but adrenaline was high and I was already grumpy from an eight hour drive.  Like I said, accidents happen, and maybe I should have been more calm about it (not like I was screaming and yelling at her).  Hindsight is 20/20.

People don't intentionally cause accidents by definition (accident=unintentional). If she intentionally crashed into the OP then yes, go about the courts to find a remedy; otherwise, it is what it is and that is why people have insurance. Do it make you feel like a real man to file a police report on someone? Do you really think the police are going to waste resources "investigating" the "crime" of dinging your door? Do you really think the DA is going to prosecute this person (if they are every even charged)? No and No. You are the person clogging up the courts and wasting the police's time with nonsense that should be resolved in a civil manner between two parties. Good Grief...

Actually I wouldn't cause an accident; there's no such thing as an "accident," vehicles don't magically crash themselves.  The overwhelming majority of accidents are entirely preventable, and human error should not get off scot-free.  Resorting to "letting insurance" pay for it is such an asinine excuse, as the rest of us paying, accident-free drivers have to still subsidize that resort.  If it wasn't for stupid actions made by stupid humans, we wouldn't need insurance at all.  Pay attention to what you're doing and you won't cause an accident.  Property cannot be replaced, despite the fallacy to the contrary, at least not perfectly; some property is irreplaceable.  Excusing someone of "making a mistake" shouldn't depend upon the extent of the damage that they caused, because the potential is always there.  Don't like it?  Don't wreck my property.

 

That co-worker does, in fact, talk to me, and has never been nicer.  What the police did with her is not my problem, nor do I care, but I can promise she'll be careful the next time she opens her door to not allow the wind to take it.  I've since sold that truck, because it was ruined in my eyes and never be the same; paint and body work made it completely worthless to me.

I don't know where you learned to drive but 2 - 3 car lengths is 40 -60 ft.

I was taught to leave 1 car length (20ft) for every 10 mph. That's 160ft at 80 mph. I myself don't think that's enough space.  At 80 mph you are traveling 117 ft. per second. 

You can stop in 40 - 60 ft going 80? Or even slow down to 50? I doubt it.

That's just dumb.

I wouldn't be any closer than 10 - 12 car lengths going 80.

Why does everyone need to ride each other's ass?

I guess for your sake don't ever drive in AL, MD, NC, VA, or Washington D.C...They are all contributory negligence states where if the defendant can provide any evidence that you were even 0.01% at fault you get nothing...Driving 80 mph would be enough...You are probably the reason for tort reforms in so many states and you are probably the reason so many slip-and-fall ambulance chasing lawyers have a job...Have you ever sneezed while driving? Bet you took your eyes off the road when you did it...throwing rocks in glass houses...

    • I knew when I bought my truck that it had off road hill decent or craw control or whatever they call it and rolled my eyes at that but it gets throw on with other options my truck has, I just never had a heads up if the highway speed regular cruise setting had anything to do with the brakes and that took me by surprise. If you've ever been to the top of Pikes Peak and watched those ahead of you on the way down with their brake lights on constantly, one can guess they are probably not gearing down or not enough anyway if their vehicle will allow and a good reason their is a brake check spot part way down where they use an infra red heat gun to check how hot ones brakes are front and rear.    Your right that once one gets out of the front range by Denver and I've not been on that stretch of 285 between Denver and Fairplay myself but I know its high and Fairplay at 10000 feet, Buena Vista at 8000, it drops a bit from there but then your going back up and over the 11000 pass and Durango is at 6500 . So yes your definitely right that 6500 and a lot higher is the theme of going anywhere out in that direction from Denver but hey, the down hill sections give fantastic fuel mileage !.    I don't even look at the fuel pumps for what premium costs here, since I live on a farm and up to this point get fuel delivered I am rarely in front of a fuel pump and when I am, I am often using card lock bulk fuel stations so it tells me what the price is AFTER I buy the fuel. Looking up on gas buddy and converting to US gallons but in Canadian dollars, regular on average of the prices listed was around 5.95 and premium is around 7.00 . That was one reason I did not go for the 6.2 half ton aside from its lack of carrying/towing if one was going by the rule of using premium fuel and until recently one could only buy regular farm gas if playing the few cents off game for farm dyed fuel for a "farm licensed pickup". But yes I hear you on the fuel price difference and like the diesel theme with it often being more expensive then gas it doesn't have quite the charm to it either as it once did although right now here for some reason the price of diesel has come down more so its now inline with the price of regular gas. 
    • I agree with this assessment. As you know I’m testing longevity with vehicles for the first time. I have a few vehicles I passed to kids and grandkids. We’re all past 100K miles some approaching 170K. I’m the only one doing 5k oil changes. The rest whatever the minder says. I’m the only one doing frequent transmission service. My odyssey the trip vehicle at 200K will be finished as a trip vehicle. I recently changed to high mileage oil, Valvoline. I can’t get past the fact that all manufacturers want to claim long service life. I just don’t make sense that they would go with low weight oil for mileage. While sacrificing longevity.
    • There's absolutely a mountain of profit in catering to the "I do my own research" crowd, people who are certain they know better. And I don't mean there isn't data to support that 0w40 produces less wear product than 0w20 in an engine like the 3.0 Duramax, that only feeds them the assurance they need. Again, my whole thing with oil selection is, sure, 0w40 or 0w30 produces less wear product. Are we talking the difference between the engine lasting only 100k versus 200k? Or are we talking more like, if the engine will already go 350k on a good 0w20 regimen recommended by the OE, is using 0w40 going to get us to 355k, assuming we can even get the rest of the truck to last that long, meanwhile sacrificing the first 5y, 100k in powertrain warranty. The answer isn't easy, there are tradeoffs.   I willfully use 0w20 Dexos D for this reason, knowing that a 0w40 will produce slightly less wear. I don't believe the delta in wear product is meaningful over the lifetime of the engine, and I place much more importance on driving style and overall feeding and care of the engine as a whole. It's the mentality that someone can abstain from alcohol their whole life which is an amazing boost to health by itself, theoretically. But if they're sedentary, that lifestyle choice will most likely kill them young despite their other, concerted efforts. Maybe someone doesn't drink AND they are the perfect picture of health and activity AND they use 0w40 AND they treat their engine perfectly. If living until 130 years is the goal, sure, do that. But it's going to be a really old truck falling apart around a good engine for that last 30 years, without a doubt.   I watched Demonworks' other video on the 100k+ 3.0 Duramax that had dealer 0w20 changes on what appears to be OLM-prescribed intervals (8-10k).   The QR codes are still present and readable on the main bearings. That's how little wear it has.   That's not proof that anyone else should stick to 0w20, but it's confirmation, for me, that 0w20 is perfectly acceptable to use in these engines.
