So I tweaked a few things over the weekend on the HD and went out for a little test run. Runs great, so great that I was pulled over and cited for two things; Pa 75 3361, driving vehicle at safe speed and pa 75 3714 A, careless driving (because I slammed second) but hey I was asking for it so whatever. I'm ok with paying the fine and getting a few points on my license but someone said I will lose my license for 15 days??? This cannot happen. Is anyone good with the laws in PA regarding this? I tried searching but actually cannot find the penalties for these and If I plead guilty then that's it, they got me. I don't know a lawyer whom I could ask so I'm at a loss here.

I appreciate any help anyone offers.

Did you squeel the tires when you slammed 2nd? If not I don't see how they can do anything about it. As far as I know theres no law saying how fast you can go through the gears and get to the speed limit.

I dont have any points right now so thats good and it wasn't a construction zone so thats even better.

I may have squealed a tad....

 

I did a little more reading and "driving vehicle at safe speeds" is mainly a "catch all" type deal I guess, meaning they can use it for just about anything they want to.

Another good one is "Driving to fast for road conditions" That could mean anything as well. :)

The careless driving charge is something the officer can tack on for damn near anything. Maybe he's mad because he drives a dodge. Just curious, was it a trooper who got ya or a local cop?

I took a look at that PennDOT PDF file, and it says if you're going 6+ MPH over the Speed Limit, you get 2 points on your license, and for all of the crap they pulled on you, you're getting 5 points, which means you're only 1 point away from getting that Special Written test!

Good luck with the ticket and whatnot, but here in my little hometown we do burnouts from the red light that's dead in front of the police station and I've never had a problem.

Yeah we have messed up system here.. you take the written test if you pass then you go to 5 points....3 points come off for evey year of good driving... so after 2 years of no tickets you go to 0 points..then you must maintain 0 points for 1 year then you records clean.. if you are at 0 for 6 months and get a ticket they can use it against if you need a hearing and yank you license for 15 days for each point. This system kills on insurance and all of these "general purpose" fines ie; To fast for conditions, Careless driving AND THE BEST ONE EVER..... OBEDIENCE TO TRAFFIC CONTROL DEVICES... leave you no way to fight back.

funny you said that, I was just about to tell the OP how lucky he is not to live in that POS state of Georgia. I got a ticket for 88 in a 70 on I-75 last summer, which came to a total of about $220. I pay it, even though 88mph on i-75 just outside of atlanta will just about get you ran off the road (for being too slow), and go about my business. About a week after the payment clears I get a letter in the mail. I owed the state of georgia an additional $200 for some "super speeder" law. Complete and utter horse sh!+

i am pretty well educated in law, most states have in place a law that can apply to almost anything...here in wisconsin its disorderly conduct, which can be applyed to almost any situation...chirping the tires, quick acceleration and so on....some people think its just cops being dicks, but most of the the time its cops trying to keep the peace

I guess that I'm just damn lucky that I didn't run across one of your fine l.e.o.'s on my way to and from D.C. this past week/weekend. 65 on an interstate?!? You've got to be kidding me. Cruise was set to 77, the whole time. Why? Because it's marked 70 here in Michigan and if you're are not going at LEAST 77, you get ran the F over. Force of habit, for me to be driving that fast I guess. :troll:
