You might want to get an attorney as well. They will look into your best interest. My wife was rear ended a month ago. She felt fine but then days later, started getting numbness down her back, arm and shoulder. Immediately went to get X-rays/CT Scan. All is OK (from a life threatening perspective) but chiropractic help was in order. They did some additional tests and found about 2 months of treatment.

 

Make sure you're ok. Especially if you blacked out. You don't want to settle (if that's what you end up doing) then find things out later. The insurance company from the at fault driver was very quick to settle. We denied settlement.

 

You are in a different scenario with your at fault driver though.... but keep those things in mind.

I think I'm going to get an attorney. It's ridiculous that this guy was driving a company car with no license. I'm going to contact the company he was working for. Also planning on the doctor Monday. I documented my pain in my back and shoulder with the police report and my insurance company. I think it will be minor as I just feel pretty sore right now. I appreciate all the info. Sorry to hear that about your wife.

thank you I will look into it. I just feel like if that wasn't a hard enough force I don't know what would be. Pictures don't really do it justice but the damage looks worse in person

It was probably hard enough. My friend was driving their 2016 Silverado and rear ended a dump truck. Airbags didn't go off. Chevy wound up taking it and looking at it. 23k+ in damage and a frame replacement... and she also hit her head on the wheel.

It was probably hard enough. My friend was driving their 2016 Silverado and rear ended a dump truck. Airbags didn't go off. Chevy wound up taking it and looking at it. 23k+ in damage and a frame replacement... and she also hit her head on the wheel.

Wow thats her whole front end. Looks pretty nasty. Hope she's alright. I went and looked under the truck. The frame on mine is definitely bent. At some point liability will make the insurance companies write off vehicles when the frame is bent. They used to. I would be skeptical of other parts that don't look damaged and then possibly fail catastrophically if involved in another collision. If that were to happen to me I certainly would throw all I had into a lawsuit with the original collision insurance that claimed the truck to be as good as or better than new. Who knows what invisible damage has occurred, and it would be fiscally impossible to our properly check each part. They need to just write them off. Insurance companies should be non profit and protect the insured first and foremost, not be looking at profits or where to recover their lost premiums.

Don't fight the insurance company alone - get an attorney. If the other driver was arrested and no permissive use, then the other vehicles insurance will likely deny the claim....meaning you will have to go through your UMPD & UMBI coverage.

Also, since the driver was driving a company vehicle he can go after the business as well. Either this situation is going to suck and take a while to get a resolution. I'd also contact GM, the dealer and NHTSA. See what they say about the air bag and seat belt.

Talk with the other drivers personal insurance and the company he works for insurance, both are liable. GM may also be liable after your research. Then talk to your insurance company and find out from all four what is covered under medical and property damage, you are entitled to the max. Then tell them all what you want to happen, if their response is unsatisfactory, contact a lawyer. In the meantime your neck, head, and back is not getting any better and gets worse every time you talk to anyone about this issue. Along with your medical visits, ensure you get memorandums from family members and co-workers documenting the extent of your moans and groans when compared prior to the accident, good luck.

My guess you will not be totalled. Especially since the airbags didn't go off.....

that's my guess too. But I am going to fight it. Brand new truck with 4K miles and this crap happens. Talk about upsetting. I got checked out by the doctors. I was diagnosed with Shoulder separation, cervical ligament sprains, and lumbar spine sprain. Everything will heal on its own, just gave me meds. So that's a plus

I'm sad to say that my 2016 Chevy Silverado was rear ended a few hours ago... I'm very upset but I'm looking for some advice. I was hit by someone when I was going 10 mph in traffic and he was going roughly 45 mph and the truck bed is buckled and quite a bit of damage. The airbags said they went off but they didn't and I nailed my head on the steering wheel. I feel like something faulty happened and not sure how I should go about solving this. I may contact chevy. Also what do you guys think about the damage? I'm really hoping it's totaled because I don't want to try to sell a truck with a accident like this on its record.. Here's some pics

Maybe I am confused, but did not think front air bags were to deploy if rear ended without hitting anything else?

I don't know a lot about airbags so you're probably right. I just figured a 50 mph impact from behind would cause them to go off

If the other accident threads are any indication then it's probably not going to get totaled. Quite a few members here have had frame replacements done on their newer trucks because it came out cheaper for insurance than totaling the truck. The good thing is you're mostly alright so the truck did it's job. Good luck with the fight.

OP, check out this link. There's a chart about 1/3 of the way down that displays each states percentage for total loss or if they use TLF. This will at least give you an idea of what your looking at in regards to your vehicle. Keep in mind your insurance company also has thier own way of calculating the value of your vehicle. If it has to be fixed demand they only use genuine GM parts.

This your personal physician that concluded this? Our Physician didn't even want to see us because it was accident related and had to go an accident specialist doctor, which in turn, referred us to Chiro. All those items you listed needs to get followed up on. Each visit is loss time from work, pain and suffering, etc etc. Just in our visits alone, we're looking at $5K in billed services. X-rays, CT Scans, chiro rehab. Don't take for granted that things will heal on its own. I would like to see test results after rehab and compare them to what they were when you were first seen before saying "I'm good".

 

Wish you much luck in your recovery process both for you and the truck. I would get multiple opinions from several shops. Use GM parts, etc. make sure it's perfect if they repair it.
