Got hit today....t-boned

Think positive. It could have been worse.

My 2014 didn't survive. Almost 5k miles on the clock when it was taken out.

 

Happened just over a month ago and has been a nightmare on many fronts.

If he failed to yield from a private lane or driveway, he is 100% at fault, even if you were driving the wrong way on a one way street. Happened to me several years ago with a lady pulling out from a gas station while I was passing a line of stopped cars to get into the left turn lane on the wrong side of the road over a double line. Police would not charge her, but, said it was her fault and so did my insurance company. MORAL - always look both ways before entering any roadway!!!

I'd get all the facts to your insurance and let them go at it. They will know the laws and rules WRT insurance and claims. Trust me, if they can get a dime from the other driver, they will.

Didnt really want to get into the details but...

 

Nope, not a parking lot. I was technically in a "non-usable lane" the part of the left turn lane that is cross hatched. And he failed to yield to oncoming traffic. He pulled between other cars that were continuing on straight and pulled out into my lane, and it was too fast to stop. I swerved to avoid a head on collision, but it wasn't enough and he tagged me with his front right part of his truck right on the passenger side of my truck.

 

The officer said since we were both at fault he would not issue a ticket. The other drivers insurance was even expired....back in 2014...but still didn't issue a ticket. Idk, seemed kinda messed up. Other driver also didn't speak much English. Si and No.....

My experience with this is:

 

if the insurance, vehicle license, drivers license is expired or invalid, that person is at fault because they should not have been driving, or the vehicle should not be on the road. thier fault regardless of circumstances.

You just posted yesterday or the day before that you were content with your 2014 vs the updated 2016. Thinking the S10 guy saw that (via google translation of course) & wanted to question just how serious you were. ;)

 

Am only joking & sorry about your truck. But glad you are alright.

 

Think IL passed the law where even illegal ah~hem undocumented immigrants had to get insurance, drivers licenses etc. Which is contradictory within itself. But cannot believe they let him go w/o at least writing him a ticket for not having insurance.

My insurance inspector just took a look. He thinks new bed side, new rear door, and then cutting out the cab corner and putting in new sheet metal.

 

He estimates $6000 for repairs....

Cheaper than I thought it would be to fix. Just let your insurance go after it-they will aggressively fight the other guy (insurance company or not) to make him pay for your truck. I had a new Tacoma rear ended and totalled in 2011 by a a guy that was driving drunk while smoking a joint. Fortunately I was not hurt. I only had the truck 6 months so it could be worse.

So as not to be a threadjack post, I'll throw in the reason I just got a new Sierra- The Tundra was a solid truck, and sure did a good job helping me and a friend's 11 year old son out of this mess. Tundra RIP 6-6-15. Not too shabby for rolling 30 feet below the road surface..... Just wish I could find the bah-stahhd that ran me off a mountain gravel road and didn't stop to make sure no one was dead.

Since I did not have to deal with car my insurance so far I'm wondering if it works in North America the same as in Germany?

If both drivers made a driving error the court will decide how to split the repair costs between the parties.

E.g. one guy gets to pay 80% of the damage on the other guys car and vice versa the other guy pays 20% to him.

I loaned mine out and he side swiped a concrete poll! It went through insurance and it was just under $3000 so yours sounds right. Replaced one door, all the trim, door Handel and painted both doors and front fender for color match. Sorry that sucks:(
