I'm glad you didn't get hurt. No ticket being issued doesn't matter a whole lot to insurance companies. Your insurance company will not want to pay if they can help it, so if they think they can get any money from the other person/insurance company, they will try to.

 

Why didn't he get a ticket for no insurance? That's a big deal here in Texas. Did he just not have proof? In Texas they can confirm insurance through state database, so the paper isn't as important anymore. Maybe they did that?

Idk why the cop didn't give him a ticket. In Illinois you must have proof of valid insurance at all times. I know because once when I was young and dumb, I got pulled over for speeding and my insurance card was 1 month overdue (had insurance, just forgot to put the valid card in my truck) and the officer gave me a ticket for not having proof of insurance. Had to go to court to prove my insurance coverage.

 

The more I think about this the more it makes me annoyed.

FWIW, I got sideswiped by an off duty police officer several years back in my Yukon. He basically changed three lanes on the interstate all at once trying to make an exit and didn't see me in my lane. He then proceeded to continue driving off the interstate and a couple of more blocks to a gas station all while I was flashing my lights at him. He claimed that he wanted to get off the interstate to not impact traffic, but I think it was to get away from any potential witnesses. He then proceeded to tell the officer and later his insurance that we switched lanes at the same time and made contact. I fought it for 9 months because I wasn't switching lanes at all. My insurance backed me the whole way and kept fighting. I wrote a detailed deposition with my version of the facts and it went to 3rd party arbitration to decide. I won and his insurance had to pay for everything. He had a few inconsistencies in his story, and I made it sound like it was suspicious that he drove so far off the interstate and was overly friendly with the responding officer. If your insurance thinks there's a decent chance to recoop money, they will try.

 

Stories like this and some of mine have got me real close to getting a windshield cam.

The officer is correct, the lane he was using is an unauthorized lane. Those lines are painted through it for a reason. He's lucky he did not receive a citation from the officer on top of the damage he is going to have to pay for.

 

Not sure what the State law on insurance is BUT the guy without insurance should have received a citation AND had his vehicle tow on his dime. No insurance = illegal to drive in most places.

To the OP: don't pay any attention to all the legal/insurance advice you are getting. The laws on this kind of thing vary all over the place from state to state (including how "illegal" it is to drive in a yellow-hatched area) so the only thing you need to worry about are YOUR laws. Your insurance company should be able to help you, regardless of whether you were (supposedly) "at fault" or not. If you think that you have liability exposure, you might want to talk to a traffic lawyer, rather than relying on your insurance company. That might be worth $100-$200 initial consultation legal fee.

And you quoted me as if I do not realize the lines are there for a reason? That was purely sarcasm. And regardless of what the hash marks means, there are times that you are forced to be on them. It wasn't like the officer and the judge were there when they painted the lines on every road. BTW here in Kansas, no insurance is hefty fine and depending on how many times you are cited will eventually lead to revocation of license.

Bummer. At least your truck is black and not a metallic flake color so it should be easy to match the new paint to the rest of the truck and you won't notice anything ever happened. :-)
