My K2 may be gone forever

First of all everybody is ok that’s the most important thing. I’d definitely call your agent (if thay are worth a sh!t) and explain everything to them including your concern about the rental a guys got to get to work right to make money to pay them and what steps they suggest you take next. After all they should want to keep you as a customer (unless it’s Allstate they apparently don’t need customers) and should be willing to make a call on your behalf. I have a ___ passenger vehicle capable of hauling ____ pounds with 4wd to drive in inclement weather to support my current lifestyle, financial and family responsibilities. So this Chevy Aveo ain’t going to cut it...

 

If they do decide to fix your truck you’ll also want to talk to YOUR AGENT about what your states diminished value laws are and what your entitled to. Just about every state is different on this including some that say tuff luck.

A lawyer won't do you any good unless you are hurt.

If so the most they can get is 1/3 of the settlement. 

People always bad mouth lawyers until you need one. Then they are your best friend. I know this first hand.

Your insurance should be working it all out for you. That why you pay them. I would also be talking to Dr. to get that sore body of you and your daughter checked out. Then a lawyer for all your pain and suffering. Yes a lawyer will take his part but thats just how the system works. You need  GOOD LAWYER not a bum. I have never been in your situation but have had friends who have and they seem to come out with a nice chunk of change.

Thanks for all the advice.  I have spoken to my agent today (State farm) to let them know what's going on.  His insurance (allstate) is the one being a pain.  At least they did call earlier to say they had spoken to their insured (the guy who hit me) and they are accepting liability.  Not sure if the guy is already out of jail or what.

 

I will consider the lawyer and talk to the wife ( her brother is a lawyer in another state).  I will also call and get Dr appointments tomorrow.  We both still have headaches.

Also glad yall are good and hope nothing comes of the headaches. I'd also be interest in seeing how the truck took the hit, changing the posting format can dramatically change the file size. Either way, this is also why I drive a truck, I've seen too many cars wrecked where I knew at first sight that no one lived. God bless.

Remember, that lawyer everyone is suggesting is going to take 33-50% of your settlement. Let your insurance company work it for free and you pocket all the payout. You will never see one cent over the max personal Injury liability of his policy lawyer or not.

You and your daughter should both go see a doctor right away, just to get checked over.  When I got hit head on, I dealt with the other driver's insurance about getting a rental.  They didn't want to authorize a truck. So I went to enterprise rental and rented a crew cab truck with my own money.  Call them and told them I had a truck rented and that they could pay for it or they could talk to my lawyer.  Needless to say they transferred the rental to them immediately.  They also reimbursed me for my son's car seat, even though he wasn't in the truck.  I also went to the doctor and got checked over, had nothing wrong, but good to get checked over.  I ended up getting a personal injury settlement from the other insurance company even though I had nothing wrong other than a little soreness.  Also got a diminished value check from the other insurance company, so if your truck isn't totaled keep that in mind.  Best of luck to you.

You won't get Jack shit if you let your insurance company try to handle it.

I hired the best personal injury lawyer in the state for my case. Sure they took 1/3 of the settlement but I walked away with a boatload of cash that I would have never saw. They took care of everything and all I had to do was wait. It could take up to a year but believe me it was worth the wait.

This is a no brainer. 

Only a fool would put this in the hands of an insurance company.

Lawyer up.

The point of a lawyer on this case is the negligence... A regular accident, sure, long drawn out and small return... Drinking and driving, texting, etc? That is just pure neglect. This isn't about recouping your losses... This is about the civil penalty for being a dumbsh!t. The law will take care of their license and time. Your civil suit should take care of all of the pita this is about to become for you and your family. Document every minute of it... Meticulously....

I’m sorry to hear that. I’m still dealing with the damn insurance companies when I was rear ended. Hope it works out the best it can.

You involve your insurance company because it's their job to take care of this crap. That's what you pay premiums for. If you have full coverage there is no reason for you to have to do anything except accept or decline offers. Anything else, you need to find another insurance company.
